Mr. Tabone replied that the pads have been graded and he would need to determine what would <br />need to be done on an individual basis if that is desired. <br />Acting Chairperson VanScoy asked if the developer believes that there would be a difference in <br />views as someone would come around the corner, with the difference in five feet. <br />Mr. Tabone stated that it would be difficult to pinpoint five feet in the field, noting that as you <br />are driving around the road ideally you would be focused on the road and not the homes as there <br />is a curve in the road in that area. He noted that not all the homes have the same setback and <br />therefore you would not typically notice that difference. <br />Commissioner Nosan agreed. <br />Mr. Tabone stated that the variation to the streetscape would avoid the situation where you create <br />a row of homes. <br />Motion by Commissioner Maul, seconded by Commissioner Nosan, to close the public hearing. <br />Motion Carried. Voting Yes: Acting Chairperson VanScoy, Commissioners Maul, Nosan, <br />Andrusko, and Brauer. Voting No: None. Absent: Chairperson Levine and Commissioner <br />Bauer. <br />Chairperson Levine closed the public hearing closed at 7:44 p.m. <br />Commission Business <br />Motion by Commissioner Nosan, seconded by Acting Chairperson VanScoy, to adopt Resolution <br />#16-07-127 approving the Findings of Fact and to adopt Resolution #16-07-128 approving a <br />variance to allow a front and side corner yard setback of twenty-five (25) feet on the Subject <br />Property. <br />Further discussion <br />Commissioner Brauer stated that the development was already approved that met the zoning and <br />code and now the request is coming back requesting a variance because of the wetlands and was <br />concerned that this could set a precedent for the future. Community Development Director <br />Gladhill stated that the City has changed its regulations but could not go back retroactively to <br />previously approved plats. He stated that the City would like to avoid wetland encroachment. <br />Commissioner Brauer stated that perhaps this would be a policy decision moving forward so that <br />multiple variances are not needed. Community Development Director Gladhill stated that the <br />issue would still come forward because of the tight building discussions, noting that it is not a <br />bad thing to approve a variance when the case is appropriate. <br />Planning Commission/July 21, 2016 <br />Page 6 of 20 <br />
