1]0.1]1 CURFEWS FOR MINORS It shall be un]awful for any pers~m under the age of fourteen (].4) years to be on or present in any public street, avenue, alley or park or other public place in the City of Ramsey between the hours of 9:30 a.m. and 5:00 a.m. of the following day, official city time, unless accompanied by his parent, guardian, or person having lawful custody and control of bis person, or unless there exists a reasonable neces- sity therefor. The fact that said child, unaccompanied by parent, guardian or other person having legal custody, is found upon any street, alley, or public place after 9:30 p.m. or before 5:00 a.m. of the following day, shall be prima facie evidence that said child is there unlawfully. 110.1. I2 PRII~]A FACIE EVIDENCE It shall be unlawful for any parent, guardian, or other person having the lawful care, custody, or control of any minor to allow or permit such minor to violate the provisions of this chapter. The finding of any minor in violation of the curfew shall be prima facie evidence that a parent, guardian, or other person h~vjng lawful care, custody, or control allowed or permitted the violation. 110.113 CURFEW PROCEDURES 1. Any police officer, upon finding a minor in violation of this chapter, shall ascertain the name and address of such minor and advise the minor that be is in violation of curfew and shall direct the minor to proceed at once to his home or usual place of abode. The police officer shall motify the parents, guardian, or person having custody or control of such minor, and the juvenile authorities. 2. ~ If such minor refuses to heed such advice or direction by any police officer, or refuses to give such police officer his correct name and address, or if the minor has been advised on a previous occasion within six (6) months that he is in violation of curfew, he shall be taken to the police department and if the parent, guardian or other adult person having custody or control of such minor cannot be located or fails to come and take charge of the m~nnr, the minor shall be r~leased to the juvenile authorities.
