1]0.1]1 CURFEWS FOR MINORS <br /> <br />It shall be un]awful for any pers~m under the age of fourteen (].4) <br />years to be on or present in any public street, avenue, alley or park <br />or other public place in the City of Ramsey between the hours of 9:30 <br />a.m. and 5:00 a.m. of the following day, official city time, unless <br />accompanied by his parent, guardian, or person having lawful custody <br />and control of bis person, or unless there exists a reasonable neces- <br />sity therefor. The fact that said child, unaccompanied by parent, <br />guardian or other person having legal custody, is found upon any <br />street, alley, or public place after 9:30 p.m. or before 5:00 a.m. <br />of the following day, shall be prima facie evidence that said child <br />is there unlawfully. <br /> <br />110.1. I2 PRII~]A FACIE EVIDENCE <br /> <br />It shall be unlawful for any parent, guardian, or other person having <br />the lawful care, custody, or control of any minor to allow or permit <br />such minor to violate the provisions of this chapter. The finding of <br />any minor in violation of the curfew shall be prima facie evidence <br />that a parent, guardian, or other person h~vjng lawful care, custody, <br />or control allowed or permitted the violation. <br /> <br />110.113 CURFEW PROCEDURES <br /> <br /> 1. Any police officer, upon finding a minor in violation of <br />this chapter, shall ascertain the name and address of such minor and <br />advise the minor that be is in violation of curfew and shall direct <br />the minor to proceed at once to his home or usual place of abode. The <br />police officer shall motify the parents, guardian, or person having <br />custody or control of such minor, and the juvenile authorities. <br /> <br /> 2. ~ If such minor refuses to heed such advice or direction <br />by any police officer, or refuses to give such police officer his <br />correct name and address, or if the minor has been advised on a <br />previous occasion within six (6) months that he is in violation of <br />curfew, he shall be taken to the police department and if the parent, <br />guardian or other adult person having custody or control of such <br />minor cannot be located or fails to come and take charge of the <br />m~nnr, the minor shall be r~leased to the juvenile authorities. <br /> <br /> <br />
