PROPOSED FINDINGS OF FACT <br /> CONDITIONAL USE PERMIT <br /> MR. JIM FRANKLIN <br /> <br />That Mr. Jim Franklin, hereinafter referred to as "Applicant", has <br />properly applied for a conditional use permit to construct an <br />advertising sign. <br /> <br />That the Applicant appeared before the Ramsey Planning and Zoning <br />Commission for a public hearing pursuant to Sections 170.013D and <br />170.054 of the City Code on July 7, 1987 and that said public hearing <br />was properly advertised and that the minutes of said public hearing are <br />hereby incorporated as part of these findings by reference. <br /> <br />3. That the subject property is legally described as follows: <br /> <br />Part of the Northeast Quarter of the Southwest Quarter of Section 28, <br />Township 32, Range 25, Anoka County, Minnesota, described as follows: <br />Beginning at the point of intersection of the West line of said <br />Northeast Quarter of the Southwest Quarter with the Southerly <br />right-of- way line of the Burlington Northern Railroad, then Southerly <br />along said West line of said Northeast Quarter of the Southwest <br />Quarter to its intersection with the Northerly right-of-way line of <br />U.S. Trunk Highway ~10 then Southeasterly along said Northerly <br />right-of-way line of said Highway a distance of 485.0 feet to the <br />actual point of beginning of tract tobe herein described then <br />continuing along the northerly right-of-way line of said Highway 140 <br />feet, then Northerly to a point on said Southerly right-of-way line of <br />said Burlington Northern Railroad 691.80 feet Southeasterly from the <br />West line of the Northeast Quarter of the Southwest Quarter as <br />measured along the West line of the Burlington Northern Railroad 140 <br />feet then Southwesterly to the point of beginning. Except road. <br />Subject to easement of record. <br /> <br />4. That the subject property is located in the I-1 Industrial District and <br /> is approximately .6 acres in size. <br /> <br />5. That the Applicant is requesting a conditional use pez-mit to construct <br /> an advertising sign on the subject property. <br /> <br />That Section 170.054 of the City Code requires that advertising signs <br />shall be constructed either on the site of the subject activity or <br />within 2500 feet of the subject activity advertised on the sign. <br /> <br />That Section 170.054 of the City Code also requires that all <br />advertising signs shall require a conditional use permit prior to <br />construction. <br /> <br />8. That the subject property is currently vacant and the Applicant plans <br /> to rent the subject property. <br /> <br />9. That the adjacent properties are located in the I-I Industrial <br /> district. <br /> <br />10. That the proposed sign will not increase traffic into or from the <br /> subject property. <br /> <br /> <br />
