REQUEST FOR CONDITIONAL USE PERMIT TO CONSTRUCT <br />ADDITION FOR RESIDENTIAL USE IN B-1 BUSINESS DISTRICT; <br />CASK OF DUANE AND BONNIE LUNDEEN <br /> By: Anne Norris, Community Development Director <br /> <br />CASE <br /> <br />Background: <br /> <br />Duane and Bonnie Lundeen are requesting a conditional use permit to construct a <br />40' x 60' addition to their existing structure at 6710 Highway il0 NW. A <br />portion of this structure would be used for a restaurant and the upper story is <br />proposed for residential use by the Lundeens. This property is located in the <br />B-1 Business District; the restaurant is a permitted use. However, the <br />residential use is not permitted in the B-1 Business district, The Lundeens <br />have stated that they are seeking a conditional use permit to live on the <br />premises for security reasons. The proposed addition will be constructed of <br />the same materials as the existing structure and would have a finished height <br />of approximately 22 feet. <br /> <br />Enclosed are the following items for your information: <br /> <br />a) Application <br />b) Site location map <br />c) Public hearing notice <br />d) Properties notified <br /> e) Elevations of proposed addition <br /> f) Proposed findings of fact <br /> g) Proposed conditional use permit <br /> <br />Observations: <br /> <br />Section 170.013D of the City Code states that "...a conditional use is a use <br />which because of certain characteristics cannot be properly classified as a <br />permitted use in the zoning district within which it is proposed..." The Code <br />continues on that such permits "...are designed to meet the problem which <br />arises where certain uses, although generally compatible with the basic use <br />classification of a particular zone, should not be permitted to be located as a <br />matter of right in every area,.." <br /> <br />Recommendation: <br /> <br />Co~nissionAction: <br /> <br />Motion to: <br />Recommend adoption of Findings of Fact 00. _ relating to Duane and Bonnie <br />Lundeen's request for a conditional use permit. <br /> <br />-and- <br /> <br />Motion to: <br />Recommend approval/denial of Duane and Bonnie Lundeen's request for a <br />conditional use permit to construct an addition for residential use on <br />the property at 6710 Highway il0 MW. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Community Development Director <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Building Official X <br /> <br /> <br />
