That Barton Sand and Gravel Company, hereinafter referred to as <br />nApplicant", has properly applied for a conditional use per. it to extract <br />aggregates and establish a bituminous asphalt operation in the I-1 <br />Industrial District. <br /> <br />2, That the Applicant appeared before the Ramsey Planning and Zoning <br />Conmlsaion for a public hearing pursuant to Section 170.013D of the City <br />Code on Hatch 3, 1987 and that said public hearing was properly advertised <br />and that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br /> <br />3. That the subject property is legally described as follows: <br /> <br />The north half of the northwest quarter, of Section 27, <br />Township 32, Range 25, Anoka County, Ninnesota with the <br />exception of two acres for a total of approximately 78 <br />acres. <br /> <br />4. That the subject property is located in the I-1 Industrial District and <br />is approximately ?8 acres in size. <br /> <br />5. That the Applicant is requesting a conditional use permit to extract <br />aggregates from the western 40 acres of the site to create a site for a <br />bituminous asphalt plant. <br /> <br />6. That the eastern 38 acres of the site is occupied by DNR Wetland <br />~2-118W, a designated protected wetland. <br /> <br />7. That the site is located in the Shoreland Overlay District a.s defined <br />in Section I?0.0112B of the City Code. <br /> <br />8. That extracting aggregates and asphalt operations are not permitted <br />uses in the I-1 Industrial District. <br /> <br />9. That the adjacent land to the north is residentially zoned and <br />developed. <br /> <br />10. That the adjacent property to the east is occupied by an active <br />landfill operation. <br /> <br />11. That the adjacent land to the south is occupied by the Cateway North <br />Airport. <br /> <br />12. That the adjacent land to the west is zoned for industrial' <br />development. <br /> <br />13. That in the past, the City has approved requests for conditional use <br />permits to grade and excavate materials. <br /> <br />14. That in the past, the City has not approved requests for conditional <br />use permits for asphalt operations. <br /> <br /> <br />
