request, to enter and inspect the premises covered by said <br />perait for safety and compliance purposes. <br /> <br />Conditional Use Permits: <br /> <br />Conditional use permits granted by this section shall be <br />temporary in nature and shall be granted to a designated <br />person who resides at a residential address. They are not <br />transferable from person to person or from address to <br />address. <br /> <br />General Provisiona~ <br /> <br />a) <br /> <br />Should a conditional use permit holder die or move to a <br />new location, the ~xisting permit shall be automatically <br />terminated, except that in the case of death, should a <br />su~wiving spouse or child, residing, at the same address, <br />desire to continue the home occupation, written notice <br />to that effect shall be given to the City Administrator <br />and the City Council may authorize continuation of that <br />permit without further hearing. <br /> <br />b) <br /> <br />Conditional use permits, once granted, may be revoked <br />prior to its original revocation date by the City <br />Council for cause after hearing before the City Council. <br />Complaints seeking the revocation of such permit shall <br />be filed with the City Administrator and may be <br />initiated by the Planning Commission or any three (3) <br />residents of the block (both sides where the home <br />occupation is being conducted). All such revocation <br />hearings shall be conducted in accordance with Section <br />170.013E of this ordinance. Publication' and notice <br />requirements shall be the same as for conditional use <br />permit application hearings. <br /> <br />c) <br /> <br />All businesses being conducted at property zoned for <br />residential use on the effective date of this ordinance <br />shall have thirty (30) days thereafter to apply for a <br />conditional use permit. <br /> <br />d) <br /> <br />Persons who were conducting a business from property <br />zoned for residential use on the effective date of this <br />ordinance must make application under Section 170.013D, <br />but may continue to conduct such businesses pending <br />final determination of their application. Should the <br />City Council deny the petition for conditional use <br />permit, all such persons shall immediately cease their <br />business activities from such residential premises. <br /> <br />37 <br /> <br /> <br />
