- 2 -

ordinance regulations. If after 60 days the other governmental
subdivisions fail to adopt the requested zoning, the requesting
City can adopt the zoning and administer and enforce the same.

The second method by which the zoning can be established
outside the City limits is to establish a Joint airport zoning
board. Such a Board is comprised of two members from each
governmental subdivision affected. The Board then proposes the
appropriate ordinances, adopts the same and administers them.
The Board has the authority to enforce zoning in any area which
fails or refuses to Join the Board.

We believe these are two reasons why Ramsey should elect to
proceed under MSA 360.063 Subd. 1 in order to adopt the
appropriate zoning.

The first reason is that, as stated above, the City needs to
"own or control" the Airport in order to proceed with either the
options in MSA 360.063 Subd. 3. After the zoning is established
by Subd. 1, the City will then be in a position to acquire
ownership or control of the Airport. The City can then qualify
for imposing zoning regulations outside of the City's territorial
limits.

In addition, when the City does achieve the owning or
controlling status, we believe that the City should not opt to
form a Joint airport zoning board. The reasoning for this is
that even though 90% of the land area in question will be in the
City of Ramsey, Ramsey would have only two votes on the Joint
board consisting of 12 members. Even though it is to be a Ramsey
Airport, Ramsey would be only equal with all other five municipal
subdivisions in zoning issues.

It should be noted, however, that Mn Dot's generally
perferred route is to adopt Joint airport zoning boards,
however, they will not force the City to adopt such a board.

At this point then, the City should consider adopting a
resolution authorizing Hakanson Anderson Associates Inc. to
proceed with the zoning phase under its initial existing
contract, and that the zoning should be pursued using MSA
360.063 Subd. 1.
