- 2 - <br /> <br />ordinance regulations. If after 60 days the other governmental <br />subdivisions fail to adopt the requested zoning, the requesting <br />City can adopt the zoning and administer and enforce the same. <br /> <br /> The second method by which the zoning can be established <br />outside the City limits is to establish a Joint airport zoning <br />board. Such a Board is comprised of two members from each <br />governmental subdivision affected. The Board then proposes the <br />appropriate ordinances, adopts the same and administers them. <br />The Board has the authority to enforce zoning in any area which <br />fails or refuses to Join the Board. <br /> <br /> We believe these are two reasons why Ramsey should elect to <br />proceed under MSA 360.063 Subd. 1 in order to adopt the <br />appropriate zoning. <br /> <br /> The first reason is that, as stated above, the City needs to <br />"own or control" the Airport in order to proceed with either the <br />options in MSA 360.063 Subd. 3. After the zoning is established <br />by Subd. 1, the City will then be in a position to acquire <br />ownership or control of the Airport. The City can then qualify <br />for imposing zoning regulations outside of the City's territorial <br />limits. <br /> <br /> In addition, when the City does achieve the owning or <br />controlling status, we believe that the City should not opt to <br />form a Joint airport zoning board. The reasoning for this is <br />that even though 90% of the land area in question will be in the <br />City of Ramsey, Ramsey would have only two votes on the Joint <br />board consisting of 12 members. Even though it is to be a Ramsey <br />Airport, Ramsey would be only equal with all other five municipal <br />subdivisions in zoning issues. <br /> <br /> It should be noted, however, that Mn Dot's generally <br />perferred route is to adopt Joint airport zoning boards, <br />however, they will not force the City to adopt such a board. <br /> <br /> At this point then, the City should consider adopting a <br />resolution authorizing Hakanson Anderson Associates Inc. to <br />proceed with the zoning phase under its initial existing <br />contract, and that the zoning should be pursued using MSA <br />360.063 Subd. 1. <br /> <br /> <br />
