Coun¢ihnember Elvig stated he would prefer the berm with plantings as opposed to the wall. <br /> <br />Councihnember Cook concurred. <br /> <br />Mayor Gamec noted one of the reasons they looked at breaking the wall up was so that it would <br />not be one big wall. <br /> <br />The consensus of the City Council was to approve the proposed berm and landscaping. <br /> <br />Councihnember Cook noted the setbacks are greater with this plan. <br /> <br />Councihnember Strommen inquired if the landscaping could be intensified in the area where the <br />units are closest to Highway 10. <br /> <br />Associate Planner Wald replied the landscaping plan is extremely dense in that area already. <br /> <br />Motion by Councihnember Pearson, seconded by Councilmember Cook, to adopt Resolution <br />#04-06-148 to approve the preliminary plat of Rivenwick 4th Addition noting the approved <br />deviations and contingent upon compliance with City Staff Review Letter dated June 4, 2004, <br />and to approve the site plan of Rivenwick 4th Addition noting the approved deviations and <br />contingent upon compliance with City Staff Review Letter dated June 4, 2004. <br /> <br />Councihnember Zimmerman asked if the fire code for the condos and townhouses would apply <br />with this development. <br /> <br />Associate Planner Wald replied that has not been determined at this point. It will be addressed in <br />discussions with the fire ordinance and does not apply to this discussion. The developer is <br />asking to be exempt fi'om the requirements and their request will be discussed during the <br />discussion of the fire sprinlder ordinance, which will be back on the table in two weeks. <br /> <br />Councilmember Kurak asked if the fire sprinklers would be required of the developer at this <br />time. <br /> <br />Associate Planner Wald replied as of now the requirements are not effective, however, if it is <br />based on a building permit this development would be subject based on the building permit. The <br />requirements are not based on platting, but are based on a building permit. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Pearson, Cook, Elvig, Kurak, <br />Strommcn, and Zimmennan. <br /> <br />Case #11: <br /> <br />Request for Final Plat Approval of Rivenwick Village; Case of Turtle Moon <br />Inc. and Ryland Homes <br /> <br />Associate Planner Wald advised staff has reviewed the revised plans for Rivenwick Village and <br />finds them acceptable.
