Voting Yes: Mayor Reimann, Councilmembers Sorteberg, <br />DeLuca and Pearson. Voting No: None. Absent: Councilmember Cox was <br />temporarily out of Council Chambers. <br /> <br />Case ~7: Trunk Storm Sewer Imorovement Pro~ect #87-21: <br /> <br />City Engineer Raatikka stated that the project is for trunk storm sewer <br />from the north side of the Burlington Northern Railroad to the Mississippi <br />River; the city must apply for a permit to locate storm sewer in the <br />Burlington right-of-way and it will cost $500 for the first 5 year period <br />and $375 for each subsequent 5 year period. <br /> <br />Councilmember Cox noted that Cty. Rd. #83 and #63 are quickly deteriorating <br />because of traffic patterns resulting from Burlington's dictates on <br />railroad crossings; unfair of Burlington to require right-of-way payments <br />to fix drainage problems that their railroad beds contribute to. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Pearson to <br />request that Burlington Northern Railroad waive the right-of-way permit <br />fees. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Counci!members Sorteberg, Cox, <br />DeLuca and Pearson. Voting No: None. <br /> <br />Discussion ensued regarding whether or not the project should proceed in <br />full or a portion thereof that will still qualify for Mn/Dot matching <br />funds. Council determined that whether or not the project proceeds in <br />full at this time, the acquisition of right-of-way is necessaz~~. <br /> <br />Motion by Cou~ncilmember DeLuca and seconded by Counci!member Sorteberg to <br />authorize the City Attorney to acquire the right-of-way for th&'trunk <br />sewer project ~87-21 in accordance with Mn/DoT requirements. <br /> <br />Mctien tarried.
