Voting Yes: Chairman Zimmer, Commissioners Deemer, LaDue, <br />Nendriksen, Sh~nway and Peterson. Voting No: None. Absent: Commissioner <br />Howell. <br /> <br />BOARD C~ AEU-U~ BUSINESS <br /> <br />Request For Variance From Height Restrictions For Accessory_ <br /> ~tructures; Case Of Mr. Gerald Bauer: <br /> <br />Mr. Gerald Bauer stated that he is requesting a variance from the 16' height <br />limit to oonstruct a barn shaped accessory structure on his 8 acre parcel at <br />6131 Green Valley Road that will have a height of 23'. Because of different <br />land elevations, the accessory structure height will not exceed that of the <br />principal structure on the property. <br /> <br />The Board proceeded to review the proposed findings of fact. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Peterson to adopt <br />Findings of Fact 0153, amended as follows, relating to Mr. Bauer's request for <br />a variance from the height restrictions for accessory structures: (Please <br />refer to findings of fact file for Findings of Fact 0153). <br /> <br />Add: #14. <br /> <br />That the mini-plat requested of Mr. Gerald Bauer by the <br />Planning and Zoning C(Emission at a previous meeting is what <br />created the necessity for this variance request. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, LaDue, <br />Hendriksen, Shu~way and Peterson. Voting No: None. Absent: Commissioner <br />Howell. <br /> <br />The Board of Adjustment proceeded to review the proposed Variance Agreement. <br /> <br />Motion by Cc~missioner Peterson and seconded by Oa]m-~ssioner Deemer to approve <br />Mr. Bauer's request for a variance to construct an accessory structure taller <br />than allowedbyCityCode and to enter into the proposed Variance Agreement <br />amended as follG~s: <br /> <br />Item #3 shall read as follows: 'The accessory structure shall be <br />finished with materials so that it matches the principal structure <br />on the property.' <br /> <br />Add Item 94 to read as follows: 'That the accessory structure height <br />shall not exceed the elevation of the principal structure on the property.' <br /> <br />Motion carried.
