By: Anne No~ris, C~,~ntt'y Devel~t Di~ec~o~ <br /> <br />Background.' <br /> <br />Mr. Lyle McLaughlin is requesting a variance from the side yard setback for <br />Lot 1~, Block 6, River's Bend Properties. The subject parcel contains a <br />ten (10) foot drainage easement along the northern boundary. Mr. <br />McLaughlin is proposing to construct a house on the parcel which would <br />leave a side yard on the south side of five (5) feet. Mr. McLaughlin has <br />stated that the variance would not be necessary if the drainage easement on <br />the northern boundary were the ordinary five (5) feet. <br /> <br />The subject property is located in the R1-U Residential district. The <br />required side yard for principal structures is ten (10) feet. Mr. <br />M~Laughlin's proposed structure would encroach on the required side yard on <br />the south by five (5) feet; Mr. McLaughlin is requesting a five (5) foot <br />variance to the side yard requirements for the south side of the property. <br /> <br />For your information, enclosed are the following items: <br /> <br />a) Application <br />b) Site location map <br />c) Public hearing notice <br />d) Properties notified <br />e) Plat showing Lot 16, Block 6 <br />f) Proposed findings of fact <br />g) Draft variance <br /> <br />Mr. M~Laughlin will be present at the meeting to explain this request. In <br />addition, I have requested that Mr. McLaughlin provide a certificate of <br />survey with a plot plan of the proposed house on the survey drawn by a <br />surveyor. <br /> <br />Recommendation: <br /> <br />Board of Adjustment Action: <br /> <br />Motion to: <br />Adopt Findings of Fact relating to Mr. McLaughlin's request <br />for a variance frem the side yard setback requirement. <br /> <br />Motion to: <br />Approve/deny Mr. McLaughlin's request for a variance fr~m the required <br />side yard setback. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Comm~ Development Director <br /> <br /> Chief of Police <br /> Finance Officer <br /> Public Works Superintendent <br />X Building Official <br /> <br /> <br />
