IIYINIIEIIWII��NV IVN�IM YV�II <br />Record ID 3958456 <br />Commissioner Nosan introduced the following resolution and moved for its adoption: <br />RESOLUTION #16-07-128 <br />R EGERIZD <br />OCJ2V2J <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO FRONT YARD <br />AND SIDE CORNER SETBACK IN THE APPROVED PLAT OF WOODLANDS 3RD <br />ADDITION AND DECLARING TERMS OF SAME. <br />WHEREAS, U.S. Home Corporation, dba Lennar (Permittee), has properly applied for a <br />variance from the minimum front yard and side corner setback length prescribed in Section 117- <br />111, Subd. (d) on portions of the property legally described as follows: <br />Lots 6-12 (inclusive) Block 2, and Lots 1-14 (inclusive) Block 3, Woodlands 3rd <br />Addition, Anoka County, Minnesota <br />(the "Subject Property"); and <br />WHEREAS, the Planning Commission met on July 7, 2016, conducted a public hearing <br />and adopted Findings of Fact #0964 relating to the request for a variance to the minimum front <br />yard and side corner setback on the Subject Property. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br />1. Based on Findings of Fact #0964, a five (5) foot variance to the thirty (30) foot front yard <br />and side corner setback, as established in Section 117-111, Subd. (d) of the Ramsey City <br />Code, is hereby granted for the Subject Property and is shown in the attached lot exhibit.. <br />2. That the Variance requires a front yard and side corner setback of 25 feet. <br />3. No construction of any building shall commence without the issuance of a building permit. <br />4. The Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br />5. That this Variance shall automatically expire if the use is not initiated by July 7, 2017, and <br />successful recording of the plat of Woodlands 3rd Addition shall constitute initiation. <br />The motion for the adoption of the foregoing resolution was duly seconded by Acting Chairperson <br />Van Scoy, and upon vote being taken thereon, the following voted in favor thereof: <br />Acting Chairperson Van Scoy <br />Commissioner Nosan <br />Commissioner Andrusko <br />Commissioner Brauer <br />Commissioner Maul <br />542558.011 <br />
