1. That Mr. Jeff Erikson, hereinafter referred to as 'Applicant', has <br />applied for a Board of Adjustment variance from the maximum height <br />allowance for accessory structures. <br /> <br />2. ~hat the Applicant a~eared before the Board of Adjustment for a public <br />hearing pursuant to Section 170.013G of the City Code on March 26, 1987 <br />and that said public hearing was properly advertised and that the minutes <br />of said public heazing are hereby ~ncorporated as ~art ef these fin~ngs by <br />reference. <br /> <br />3. That the subject property is ger~rally known as 15270 St. Francis Blvd. <br />N.W. and is legally described as fallo~s= <br /> <br />That part of the northwest quarter of the sout~est quarter <br />of Sectim 24, Township 32, l~nge 25, Anoka County, Minnesota <br />described as follows. Beginning at the north~st corner cf <br />said nort~est quarter cf the southwest quarter, then east on <br />the north line thereof for a distance cf 870 feet to the <br />westerly line of public road nc~ kncwn as State ~ighway %47, <br />then south twenty-five degrees east along the said westerly <br />line cf said public =(md for a distance of 165.50 feet, then <br />west and tmrallel with the said north line of the northwest <br />quarter cf the southwest quarter for a distance of 939.9 feet <br />to the west line of said northwest quarter of the southwest <br />quarter, then north for a distance cf 150 feet to the place cf <br />beginning, subject to easement cf Rural Cooperative Power <br />Association dated April 12, 1967. <br /> <br />4. That the subject property is located in the B-1 Business District and <br />is approximately three acres in size. <br /> <br />5. That Section 170.015G of the City Code specifies that accessory <br />structures shall be no taller than 16 feet. <br /> <br />6. That the Applicant is proposing to construct an accessory structure <br />approximately 22 feet tall. <br /> <br />7. That the Applicant is requesting a variance from the maximum height <br />allowance s~ified in Section 170.015G of the City Code and is requesting <br />a variance cf approximately 6 feet. <br /> <br />8. That on December 22, 1986, the applicant properly applied for a <br />building permit to construct an accessory structure cf approximately 26' x <br />36' which c(m~lied with Secti(~ 170.015G of the City Code. <br /> <br />9. That the Applicant inadvertently gave approval to the contractor to <br />proceed constructing the accessory structure taller than permitted by City <br />Code. <br /> <br />10. That the Applicant has stated that such variance is necessary for the <br />preservation and enjoyment of a substantial property right similar to that <br />possessed by other properties in the B-1 Business District. <br /> <br /> <br />
