1. ~at Mr. 3ohn Myzdal~ bereinafte£ to ze£e£red to as 'Applicant'~ has <br />properly applied for a Board of i%djustment variance from the Mississippi River <br />setback o <br /> <br />2. That the Applicant appeared before the Board of Adjustment for a public <br />hearing p~rsuant to Section 170.0L12G cf the City Code c~ March 26, 1987 and <br />that said tmblic hearing was properly advertised and the minutes of said public <br />hearing are hereby incorporated as a part (If these findings by reference. <br /> <br />3. That the subject property is generally known as 14600 Bowers Drive N.W. and <br />is legally described as follows: <br /> <br />Lots 18 and 19, except the southeasterly sixty feet of said <br />Lot 19, as measured at r!.ght angles to the southeasterly line <br />of said Lot 19, Bowers Mississippi Acres, Anoka County, <br />Minnesota, subject to restrictions, reservations and easements <br />of record, if any. <br /> <br />4. That the subject property is located in the R-1R Rural Residential <br />District. <br /> <br />5. That the subject property is located in the Critical River Overlay <br />District. <br /> <br />6. That Section 170.0112G of the City Code requires a minimum setback frem the <br />Mississippi River of two-hundred feet frcm the ordinary high water mark. <br /> <br />7. That the Applicant is proposing a setback frcm the river of one-hundred <br />and thirty feet and is requesting a variance to the two-hundred foot setback <br />requir~ment. <br /> <br />8. That the Applicant's variance requires ~ approval due to its location in <br />the Critical River Overlay District. <br /> <br />9. That the Applicant tins met with Mr. Joan Stine, DNR, conce.~ning this <br />variance request. Mr. Stine has ccemented that he has no ~bjectlon to the <br /> <br />Applicant' s request. <br /> <br />10. That the Appli~ has stated that there are unique oomfitions applying to <br />the property in question; r~.ly, the river, the topography of the lot and <br />the lot size, that do not apply generally to other properties in the R-IR <br />District. <br /> <br />11. That the Applicant has stated that such variance is necessary for the <br />preservation and enjoyment of substantial property rights similar to <br />those possessed by other properties in the R-IR Residential District. <br /> <br />12. That the special conditions do not result fr~m the action of the <br /> <br />13. That if the variance is granted, the variance will not allow the <br />Applicant any special privilege that is denied by the Zoning Ordinance to <br />other owners of lands in the R-iR Residential District. <br /> <br /> <br />
