Amendomnt by Cc~nissioner IaDue and seoor~d by Ommissioner Dee~er to not <br />refer Mr. Jeff Erikson's case to City Council ar~ to request that the City <br />Attorney pr~ide the Board of Adjustment with a legal opinion re~arding <br />whether the Board should apply l%esidential or B-1 standards and the <br /> <br />repercussi~m associated with each situation. <br /> <br />Further Discussion: Commissioner Hendriksen noted that he has seen <br />carriage-~ouse type structures in other communities, Minnetonka for <br />instance, and requested that Ms. Norris research how other communities <br />address situations of 'impr~ed living sp~ce' above ~arages. <br /> <br />~dment carried. Voting Yes: Chairman Zimmer, (lmnissioners Howell, <br />~endriksen, wnoe, Peterson, Sh~ay and ~=~er. Voting No.. None. <br /> <br />Motion failed. Voting Xes.. None. Voting No: Chairman Zimmerman, <br />G0mmissioners Deemer, Sh~ay, Peterson, ~endriksen and LaDue. Abstain: <br />C(mm~ssioner }lowell. <br /> <br />Motion by Com~ssioner Deemer and seconded by Commissioner Peterson to <br />table Mr. Jeff Erikson's request for a variance until the Board of <br />Adjustment receives the requested report frc~ the City Attorney. <br /> <br />Further Discussion: Commissioner Peterson stated that in the m~antime, Mr. <br />Erikson should research his alternatives with the Building Inspector and <br />Ommmnity Develc~m~nt Director. Commissioner Deemer stated that if Mr. <br />Erikson went with a single story garage, he would only need a setback <br />variance; applying B-1 standards, which includes garage, office and <br />warehouse use, a variance to height would not be required as long as the <br />building remains under 35 feet in height but he would still r~_cd a setback <br />wariance and the property would be taxed accordingly. <br /> <br />Motion carried. Voting Yes: Chairman Zi~merman, Ccmm~issioners Peterson, <br />~mer, Sh~ay, IalX~, ~r~lriksen and ~well. Voting No: None. <br /> <br />Motion by Co_mm_issioner LaDue and seconded by Commissioner Shumway to <br />adjourn the regular Board of Adjustment meetJung. <br /> <br />Motion carried.
