PROPOSED FINDINGS 0F FACT <br /> l/l. JOItN PLOECER <br /> <br />That ~r. John Plo,get, hereinafter re£erzed to as nApplicant", has <br />properly applied for a Board of Adjustment variance from the front yard <br />setback· <br /> <br />That the Applicant appeared before the Board of Adjustment for a public <br />hearing pursuant to Section I?0.013G of the City Code on April 30, 1987 <br />and that said public hearing vas properly advertised and minutes of the <br />said public hearing are hereby incorporated as part of these findings <br />by reference. <br /> <br />That the subject property is generally known as 15640 Juniper Ridge <br />Drive N.W. and is legally described as follows: <br /> <br />Lot 2, Block 5, Reilley Estates, Anoka County, Hinnesota <br /> <br />That the subject property is located in the R1-R Rural Residential <br />District. <br /> <br />That the subject property is located in the Scenic River Overlay <br />District. <br /> <br />That the subject property is approximately one acre in size. <br /> <br />That Section l?0.016A of the City Code requires a minimum front yard <br />setback of 40 feet· <br /> <br />That the Applicant is proposing a front yard setback of 25 feet. <br /> <br />That the Applicant has stated that there are unique conditions applying <br />to the property in question; namely, trees located on the lot that <br />would have to be removed in order for the Applicant to meet the <br />requirements of the City Code; this does not apply generally to other <br />properties in the R1-R District. <br /> <br />10. That the Applicant has stated that such variance is necessary for the <br /> preservation and enjoyment of substantial property rights similar to <br /> those possessed by other properties in the Rl-lResidential District. <br /> <br />11. That the special conditions do not result from the action of the <br /> Applicant. <br /> <br />12. That if the variance is granted, the variance will not allow the <br /> Applicant any special privilege that is denied by the Zoning Ordinance <br /> to other owners of land in the R1-R Residential District. <br /> <br />13. That the Applicant has stated that he is requesting the minimum <br /> variance to alleviate the hardship. <br /> <br />14. That the variance, if granted, viii not be materially detrimental to <br /> the purposes of the Zoning Ordinance or other property in the R1-R <br /> Residential District. <br /> <br /> <br />
