REQUEST FOR VARIANCE FROM MISSISSIPPI RIYER SETBACK; <br /> CASE OF MR. RICHARD KIECKER <br /> By: Community Development Director Anne Norris <br /> <br />Background: <br /> <br />Mr. Richard Kiecker is requesting a variance from the Mississippi River <br />setback in order to construct an addition to his home at 14700 Bowers Drive <br />N.W. Mr. Kiecker is proposing to add a 20' x 20' addition on the west side <br />of his house facing the Mississippi River. The house is approximately 1~_25 <br />feet from the Mississippi River; the addition will encroach on the existing <br />river setback by 20 feet, leaving a river setback of approximately 105 <br />feet. -~ <br /> <br />Mr. Kiecker's property is in the Critical River Overlay District. <br />According to Section 170.0112G of the City Code, the setback from the river <br />is 200 feet. <br /> <br />For your information, the following items are enclosed: <br /> <br />a) Application <br />b) Site location map <br />c) Public hearing notice <br />d) Properties notified <br />e) Proposed plot plan <br /> f) Proposed findings of fact <br /> g) Proposed variance <br /> <br />Observations: <br /> <br />John Stine, DNR, has reviewed Mr. Kiecker's request and has stated that if <br />the proposed addition doesn't encroach on the river setback any greater <br />than structures on adjacent properties, he has no objection to Mr. <br />Kiecker's request. One of Mr. Kiecker's neighbors has a river setback of <br />approximately 100 feet and a neighbor on the other side has a river setback <br />of approximately 95 feet with a covered deck that encroaches in the yard by <br />approximately 10 feet. <br /> <br />Recommendation: <br /> <br />Board of Adjustment Action: <br /> <br /> Motion to: <br /> Adopt Findings of Fact__ relating to Mr. Kiecker's request for a <br /> variance from the Mississippi River setback. <br /> <br /> -and- C~ <br /> <br /> ~~e a~ck~r.
