PROPOSED FINDINGS OF FACT <br /> MR. JERRY NYBERG <br /> <br />That Mr. Jerry Nyberg, hereinafter referred to as "Applicant", has <br />properly applied for a Board of Adjustment Variance from Section <br />170.015G of the City Code. <br /> <br />That the Applicant appeared before the Board of Adjustment for a public <br />hearing pursuant to Section 170.013G of the City Code on May 28, 1987 <br />and that said public hearing was properly advertised and that the <br />minutes of said public hearing are hereby incorporated as part of these <br />findings by reference. <br /> <br />That the subject property is generally known as 14420 Bowers Drive N.W. <br />and is legally described as follows: <br /> <br />Lot 2, Block 1, Bowers Mississippi Acres, 2nd Addition, <br />Anoka County, Minnesota <br /> <br />4. That the subject property is located in the R-iR Residential District <br /> and is approximately .77 acres in size. <br /> <br />5. That the subject property is located in the Critical River Overlay <br /> District. <br /> <br />6. That the Applicant is proposing to construct a 10-1/2' x 30' addition <br /> on the east side of his garage. <br /> <br />7. That the existing garage is located nearer the front lot line than the <br /> principal structure on the subject property. <br /> <br />That Section 170.015G of the City Code specifies that accessory <br />structures shall not be located nearer the front lot line than the <br />principal structure. <br /> <br />That the existing garage is approximately 19 feet from the principal <br />structure and the house is approximately 277 feet from the front <br />lot line and the existing garage is approximately 230 feet from the <br />front lot line. <br /> <br />10. That John Stine of the DNR has reviewed the Applicant's request and has <br /> no objections. <br /> <br />11. That there are exceptional circumstances that do no apply generally to <br /> other properties in the R-iR Residential District in that the property <br /> owners in that area generally regard their front yard as that part of <br /> the yard facing the Mississippi River. <br /> <br />12. That the special conditions, namely the Mississippi River, do not <br /> result from the actions of the Applicant. <br /> <br />13. That if the variance is granted, the Applicant will not be granted any <br /> special privileges that are denied by the Zoning Ordinance to other <br /> owners of property in the R-iR Residential District. <br /> <br /> <br />
