16. That the Applicant has stated that there are unique conditions applying to the property in question~ namely, the Mississippi River and the lot size, that do not apply generally to other properties in the Ri-I{ District. 17 That the subject property was platted prior to the City's adoption of the Critical River Overlay District standards. 18. That the Applicant has stated that such variance is necessary for the preservation and enjoyment of the substantial property rights similar to those possessed by other properties in the Ri-I{ Residential District. 19. That the special conditions do not result from the actions of the Applicant. 20. That if the variance is granted, the variance will not allow the Applicant any special privilege that is denied by the Zoning Ordinance to other owners of land in the R1-R Residential District. 21. That the Applicant has stated that he is requesting the minimum variance to alleviate the hardship. 22. That the variance, if granted, will not be materially detrimental to the purposes of the Zoning Ordinance and the Critical River 0veraly District or other property in the Ri-R Residential District. 23. That the variance will not increase the congestion of public streets or substantially impair property values within the neighborhood. The motion for the adoption of the foregoing findings of fact was duly seconded by Commissioner Hendriksen and upon vote being taken thereon, the following voted in favor thereof: Chairman Zimmerman Commissioner Hendriksen Commissioner Howell Commissioner LaDue Commissioner Peterson and the following voted against the same: None and the following abstained: None and the following were absent: commissioner Holm Commissioner Shumway whereupon said findings of fact were declared duly adopted by the Ramsey Board of Adjustment this the 30th day of April, 1987. -2 -
