PROPOSED FINDINGS OF FACT <br /> HR. WAYNE SWEDAL <br /> <br />1. That Mr. Wayne Swedal, hereinafter referred to as "Applicant", has <br />properly applied for a Board of Adjustment Variance from Section 170.015G <br />of the City Code. <br /> <br />2. That the Applicant appeared before the Board of Adjustment for a public <br />hearing pursuant to Section 170.013G of the City Code on July 2, 1987 and <br />that said public hearing was properly advertised and that the minutes of <br />said public hearing are hereby incorporated as part of these findings by <br />reference. <br /> <br />3. That the subject property is legally described as follows: <br /> <br />That part of Government Lots 1 and 2, Section 30, Township <br />32, Range 25, Anoka County, Minnesota, described as follows: <br />Beginning at the intersection of the line between said <br />Government Lots 1 and 2 and its intersection with the <br />easterly line of Ramsey Road as platted in Bowers <br />Mississippi Acres, then North 17 degrees 40 minutes East a <br />distance of 91.5 feet, then continue along said easterly <br />line on a curve to the left with a center angle of 17 <br />degrees 40 minutes and a radius of 1031.25 feet a distance <br />of 8.5 feet, then South 72 degrees 20 minutes East a <br />distance of 200 feet to a point on a line parallel with and <br />200 feet easterly of said easterly line of Ramsey Road, then <br />Southwesterly along said parallel line on a curve to the <br />right with a center angle of 17 degrees 40 minutes and a <br />radius of 1231.25 feet a distance of 8.5 feet, then South 17 <br />degrees 40 minutes West a distance of 91 .5 feet, then North <br />72 degrees 20 minutes a distance of 200 feet to the point of <br />beginning, containing .46 acres more or less. For the <br />purposes of this description the line between Government <br />Lots 1 and 2 is assumed to bear east and west. <br /> <br />4. That the subject property is located in the R-iR Residential District <br /> and is approximately .46 acres in size. <br /> <br />5. That the subject property is also located in the Critical River Overlay <br />District. <br /> <br />6. That the Applicant is proposing to construct an accessory structure on <br />a vacant lot. <br /> <br />7. That the vacant lot is adjacent to the Applicant's residence. <br /> <br />8. That the vacant lot is presently owned by the Applicant. <br /> <br />9. That Section 170.015G of the City Code states that no accessory <br />structure shall be constructed on any lot prior to the time of construction <br />of the principal building on that lot. <br /> <br />10. That John Stine of the DNR has reviewed the Applicant's request and has <br />no objections to the proposed accessory structure. <br /> <br /> <br />
