CASE #2: <br /> <br />REQUEST FOR VARIANCE FROM SECTIONS 170.015F AND 170.016H <br />OF THE CITY CODE REGARDING SETBACK FROM THROROUGHFARES; <br />CASE OF MR. ROBERT MULLER <br /> By: Community Development Director Anne Norris <br /> <br />Background: <br /> <br />Mr. Robert Muller is constructing a 20,000 square foot commercial/retail <br />shopping center on the southwest corner of 167th Avenue N.W. and St. <br />Francis Blvd. The shopping center is set back approximately 83 feet'~from <br />the centerline of St. Francis Blvd. Sections 170.015F and 170.016H require <br />the setback from thoroughfares to be at least 110 feet from the centerline. <br />A variance of approximately 27 feet is required for the structure to <br />encroach on the required setback. <br /> <br />For your information, the following items are enclosed: <br /> <br />a) Site location map <br />b) Public hearing notice <br />c) Properties notified <br /> <br />d) Site plan <br />e) Proposed findings of fact <br />f) Proposed variance <br /> <br />Ob s ervat ions: <br /> <br />As you know, the City is participating in the site improvements for this <br />project using tax increment financing. The site plan for the project was <br />reviewed by City Staff, the City Engineer, the Planning and Zoning <br />Commission and the City Council; the setback of the structure from St. <br />Francis Boulevard was overlooked at all levels of review. The proposed <br />structure is set back approximately as far as Northern Bank building on the <br />north side of 167th Avenue N.W. <br /> <br />The development agreement for the project requires Mr. Muller to donate any <br />additional right-of-way that would be needed for turn lanes or improvements <br /> <br />Recommendation: <br /> <br />Board of Adjustment Action: <br /> <br />Motion to: <br />Adopt Findings of Fact <br />for a variance. <br /> <br />relating to Mr. Robert Muller's request <br /> <br />-and- <br /> <br />Motion to: <br />Approve/deny Mr. Robert Muller's request for a variance from Sections <br />170.015F and 170.016H of the City Code. <br /> <br />Review Checklist: <br /> <br />Administrator X <br />Attorney <br />Engineer X <br />Community Development Director X <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Building Official X <br /> <br /> <br />
