PROPOSED FINDINGS OF PACT <br />MR. ROBERT MULLER <br /> <br />1. Mr. Robert Muller, hereinafter referred to as "Applicant", has properly <br />applied for a Board of Adjustment variance from the required setback from <br />thoroughfares. <br /> <br />2. That the Applicant appeared before the Board of Adjustment for a public <br />hearing pursuant to Section 170.013G of the Ramsey City Code on July 23, <br />1987 and that said public hearing was properly advertised and that the <br />minutes of said public hearing are hereby incorporated as a part of ,these <br />findings by reference. <br /> <br />3. That the subject property is generally known as 5900 167th Avenue N.W. <br /> and is legally described as follows: <br /> <br />That part of the southwest quarter of the southeast quarter of <br />Section 11, Township 32, Range 25, Anoka County, Minnesota <br />described as follows: Beginning at the northwest corner of said <br />southwest quarter of the southeast quarter, then south along the <br />west line of said southwest quarter of the southeast quarter a <br />distance of 331.3 feet, then east parallel with the north line of <br />said northwest quarter of the southeast quarter to the centerline <br />of State Trunk Highway #47, then northerly along said centerline <br />of highway to the north line of said southwest quarter of the <br />southeast quarter, then west along the north line of said <br />southwest quarter of the southeast quarter to the point of <br />beginning. <br /> <br />-and- <br /> <br />The south 94.99 feet of the north 426.29 feet (as measured along <br />the west line) of the part of the southwest quarter of the <br />southeast quarter of Section 11, Township 32, Range 25, Anoka <br />County, Minnesota lying westerly of the centerline of Trunk <br />Trunk Highway #47, except roads subject to easement of record. <br /> <br />4. That the subject property is located in the RB Rural Business District <br /> and is approximately 6.1 acres in size. <br /> <br />5. That Sections 170.015F and 170.016H of the City Code require a minimum <br />setback from thoroughfares of 110 feet from the centerline. <br /> <br />6. That the Applicant is constructing a 20,000 square foot commercial/ <br />retail facility which is set back from St. Francis Blvd. by approximately <br />83 feet. <br /> <br />7. That the Applicant is requesting a variance of approximately 27 feet <br />from the required from St. Francis Blvd. <br /> <br />8. That the site plan for the commercial structure on the subject property <br />was reviewed by City Staff, City Engineer, Planning and Zoning Commission <br />and City Council and the setback from St. Francis Blvd. was overlooked by <br />all reviewers. <br /> <br />9. That the variance is necessary for the preservation of a substantial <br />property right, namely the construction of the shopping center, similar to <br />that possessed by other properties in the RB Rural Business District. <br /> <br /> <br />
