, , PI~OPOSED FINDINGS OF FACT <br /> HR o ~D¥ TRIEHERT <br /> <br />1. That Mr. Randy Triemert, hereinafter referred to as "Applicant", has <br />properly applied for a Board of Adjustment variance from Sections 170.015F <br />and 170.016A of the City Code regarding setback from thoroughfares. <br /> <br />2. That the Applicant appeared before the Board of Adjustment for a public <br />hearing pursuant to Section 170.013G of the Ramsey City Code on-August 27, <br />1987 and that said public hearing was properly advertised and the minutes <br />of said public hearing are hereby incorporated as part of these findings by <br />reference. <br /> <br />3. That the subject property is generally known as 17350 St. Francis Blvd. <br />N.W. and is legally described as follows: <br /> <br />Lot 10, Auditor's Subdivision No. 27, Anoka County, Minnesota. <br /> <br />4. That the subject property is located in the R-iR Rural Residential <br />District and is approximately .56 acres in size. <br /> <br />5. That Sections 170.015F and 170.016A of the City Code require a minimum <br />setback of 110 feet from the centerline of thoroughfares. <br /> <br />6. That the Applicant had a home on the subject property located <br />approximately 93 feet from the centerline of St. Francis Blvd. <br /> <br />7. That the Applicant's home was constructed prior to the adoption of the <br />requirement of the 110 foot setback from thoroughfares. <br /> <br />8. That more than 50% of the Applicant's home was destroyed by fire in <br />1986. <br /> <br />9. That Section 170.015H of the City Code requires all nonconforming uses <br />that are more than 50% destroyed to conform to the current City Code. <br /> <br />10. That the Applicant is proposing to reconstruct his house on the site of <br />the original structure. <br /> <br />11. That the Applicant is requesting a variance of approximately 17 feet <br />from the required setback from the centerline of St. Francis Blvd. <br /> <br />12. That there are unique circumstances applying to the Applicant's <br />property, namely, that the original house on the subject property was <br />constructed prior to the adoption of the setback requirements. <br /> <br />13. That the Applicant has stated that the variance is necessary for the <br />preservation of a substantial property right, namely, the right to <br />reconstruct his house on his property. <br /> <br />14. That the special conditions do not result from the actions of the <br />Appl ic ant. <br /> <br />15. That if granted, the variance will not grant the applicant any special <br />privilege that is denied by the Zoning Chapter to other owners of lands in <br />the R-1R Residential District. <br /> <br /> <br />
