PROPOSED FINDINGS OF FACT <br />~. RONALD FISCHL <br /> <br />1. That Mr. Ronald Fischl, hereinafter referred to as "Applicant," has <br />applied for a Board of Adjustment variance from Sections 170.015F and <br />170.016A of the City Code regarding setback from thoroughfares. <br /> <br />2. That the Applicant appeared before the Board of Adjustment for a public <br />hearing pursuant to Section 170.013G of the Ramsey City Code on September <br />24, 1987 and that said public hearing was properly advertised and the <br />minutes of said public hearing are hereby incorporated as part of these <br />findings by reference. <br /> <br />3. That the subject proeprty is generally known as 15850 St. Francis <br />Boulevard N.W. and is legally described as follows: <br /> <br />The South 450 feet of the North 516 feet of the Southeast Quarter of <br />the Southeast Quarter of Section 14, Township 32, Range 25, Anoka <br />County, Minnesota, lying West of the centerline of State Trunk Highway <br />47. <br /> <br />4. The the subject proeprty is located in the R-iR Rural Residential <br />district and is approximately 9.2 acres in size. <br /> <br />5. That the adjacent properties are also located in the R-IR Rural <br />Residential district. <br /> <br />6. That the Applicant is constructing an above ground swimming pool which <br />is located approximately 85 feet from the centerline of St. Francis <br />Boulevard N.W. and which is located in the front yard of the subject <br />property. <br /> <br />7. That Sections 170.015F and 170.016A of the City Code require all <br />structures to be located at least one hundred ten feet from the centerline <br />of major thoroughfares. <br /> <br />8. That Section 170.015G of the City Code requires detached accessory <br />structures to be located in side or rear yards. <br /> <br />9. That the Applicant is requesting a 25 foot variance to construct the <br />above-ground swimming pool in the required setback from St. Francis <br />Boulevard. <br /> <br />10. That the Applicant is requesting a variance to construct a detached <br />accessory structure, an above-ground sw~,~ing pool, in his front yard. <br /> <br />11. That the Applicant has stated that the swimming pool is a temporary <br />structure. <br /> <br />12. That there are not unique or exceptional circumstances applying to the <br />subject property. <br /> <br />13. That if granted, the variance will not grant the Applicant any special <br />privilege that is denied by the Zoning Chapter of the City Code to other <br />property owners in the R-1R Residential district. <br /> <br /> <br />
