CASE #4: <br /> <br />REQUEST FOR VARIANCE FROM SECTION 170.076.24 OF THE CITY CODE <br />REGARDING SETBACK FROM THE RUM RIVER; CASE OF A.J. PARENT COMPANY <br />By: Community Development Director Anne Norris <br /> <br />Background: <br /> <br />As you recall, at your August meeting Mr. Parent of the A.J. Parent Company <br />appeared to request a variance from Section 170.076.24 of the City Code <br />regarding encroaching on the required Rum River setback. At that time, the <br />Board recommended that the variance be granted if the house and the garage <br />were straightened and aligned with the front yard setback. In addition, <br />the Board stated that they would permit a maximum 27 foot encroachment on <br />the Rum River setback provided that the proposed structure was consistent <br />with setbacks of structures on adjacent properties. The Board also <br />specified that no walkout on the river would be permitted. <br /> <br />Since that time, Mr. Parent has determined that the conditions of that <br />variance are not acceptable. Mr. Parent is again requesting a variance of <br />approximately 40 feet from the Rum River setback of 150 feet. <br /> <br />Mr. Parent met with Mr. Stine of the DNR to review the site and proposed <br />house plans. Mr. Stine determined that the structure on the northwest side <br />of Mr. Parent's parcel is approximately 107 feet from the river and the <br />structure on the southeast side of Mr. Parent's lot is approximately 113 <br />feet from the Rum River. Mr. Parent is proposing to construct his <br />structure approximately 110 feet from the Rum River. This appears to be in <br />accordance with the setbacks of the structures on adjacent properties. <br /> <br />For your information, the following items are enclosed: <br /> <br />a) Site location map <br />b) Public hearing notice <br />c) Properties notified <br />d) Site plan <br /> e) Proposed findings of fact <br /> f) Proposed variance <br /> <br />Recommendation: <br /> <br />Board of Adjustment Action: <br /> <br />Motion to: <br />Adopt Findings of Fact <br />A.J.
