CASE ~I: <br /> <br />REQUEST FOR VARIANCE FROM SECTION 170.016F OF THE CITY CODE <br />REGARDING REAR YARD SETBACK; CASE OF MR. WILLIAM DUBATS <br /> <br /> By: Anne Norris, Community Development Director <br /> <br />Background: <br /> <br />Mr. William Dubats is requesting a variance to construct a self-service <br />storage facility at 6802 138th Avenue N.W. This facility will be <br />constructed immediately north of the existing self-service storage facility <br />at 13760 Ebony Street N.W., also owned by Mr. Dubats. Mr. Dubats is <br />proposing to construct the southern-most structure approximately 5 feet <br />from the southern property line. Section 170.016F of the City Code <br />requires a rear yard setback of 35 feet. <br /> <br />For your information, the following items are enclosed: <br /> <br />a) Site location map <br />b) Public hearing notice <br />c) Properties notified <br />d) Proposed findings of fact <br />e) Proposed variance <br /> <br />Observations: <br /> <br />As you recall, Mr. Dubats appeared before the Planning and Zoning <br />Commission for a conditional use permit and site plan review for this <br />self-service storage facility. The City Council approved the conditional <br />use permit and approved the site plan contingent upon Mr. Dubats obtaining <br />a variance from the rear yard setback. Another condition of the <br />development permit requires that Mr. Dubats provide a 15 foot driveway <br />easement across the northern boundary of his existing facility to provide <br />access to the proposed facility. <br /> <br />Recommendation: <br /> <br />Board of Adjustment Action: <br /> <br />Motion to: <br />Adopt Findings of Fact <br />variance. <br /> <br />relating to Mr. Dubats' request for a <br /> <br />-and- <br /> <br />Motion to: <br />Approve/deny Mr. Dubats' request for a variance. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Community Development Director <br /> <br />Chief of Police <br />Finance Officer <br />Building Official <br />Planning Commission <br /> <br />X <br />X <br /> <br /> <br />
