CASE ~I: <br /> <br />REQUEST FOR VARIANCE FROM SECTION 170.016F OF THE CITY CODE <br />REGARDING REAR YARD SETBACK; CASE OF MR. WILLIAM DUBATS <br /> <br /> By: Anne Norris, Community Development Director <br /> <br />Background: <br /> <br />Mr. William Dubats is requesting a variance to construct a self-service <br />storage facility at 6802 138th Avenue N.W. This facility will be <br />constructed immediately north of the existing self-service storage facility <br />at 13760 Ebony Street N.W., also owned by Mr. Dubats. Mr. Dubats is <br />proposing to construct the southern-most structure approximately 5 feet <br />from the southern property line. Section 170.016F of the City Code <br />requires a rear yard setback of 35 feet. <br /> <br />For your information, the following items are enclosed: <br /> <br />a) Site location map <br />b) Public hearing notice <br />c) Properties notified <br />d) Proposed findings of fact <br />e) Proposed variance <br /> <br />Observations: <br /> <br />As you recall, Mr. Dubats appeared before the Planning and Zoning <br />Commission for a conditional use permit and site plan review for this <br />self-service storage facility. The City Council approved the conditional <br />use permit and approved the site plan contingent upon Mr. Dubats obtaining <br />a variance from the rear yard setback.
