CASE <br /> <br /> PUBLIC HEARING " <br /> REQUEST FOR VACATION OF EASEMENT; <br /> CASE OF TURTLE MOON INC. <br />By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />The City Council recently granted final plat approval to Pdvenwick Village, a mixed use planned' <br />unit development consisting of 140 dwelling units in the southeast quadrant of Hwy. #10 and <br />Riverdale Drive N.W. The underlying outlot that makes up the plai contains a drainage and <br />utility easement for a ponding area. That ponding area is being reconfigured with the plat of <br />Rivenwick Village. Therefore, the existing drainage and utility easement must be vacated and <br />replaced with the neTM easement as shown on the final plat of Rivenwick Village. The following <br />items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />Site location map <br />Exhibit of underlying easement to be vacated <br />Proposed ordinance <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the subject property of the public hearing to vacate the easement. <br /> <br />Observations: <br /> <br />A public hearing and Council ordinance is required in order to vacate the underlying drainage <br />and utility easement that exists as part of Rivenwick 3rd Addtion. <br /> <br />Recommendation: <br /> <br />City Staff recommends introduction of the enclosed ordinance to vacate the existing easement. <br /> <br />Council Action: <br /> <br />Motion to introduce Ordinance #04- <br />Rivenwick 3rd Addition. <br /> <br />to vacate the drainage and utility easement in Outlot A, <br /> <br />Review Checklist: <br /> <br />City Engineer <br />City Attorney <br />Planners <br /> <br />CC: 06/22/04 <br /> <br />-115- <br /> <br /> <br />
