10. <br /> <br />11. <br /> <br />t2. <br /> <br />13. <br /> <br />FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of <br />the fire lanes on the Site shall be as directed by the City's Fire Chief. <br /> <br />LIGHTING. The site plan indicates there will be no outside lighting on the Site. <br /> <br />BUILDING FACADE. The Pennittee a~ees to construct all building /:aces of <br />the same material as listed on the Building Elevations Plan prepared by DBA <br />Architects dated May 17, 2004. <br /> <br />STORMWATER MANAGEMENT FEE. The Storrnwater Management Fee <br />shall be due at the closing of the sale of the Development Property to the <br />P ermittee. <br /> <br />REQUIREMENTS FOR BUILDING PERMIT. No building permit for the Site <br />will be'issued until the Permittee has: 'a) signed and returned this Development <br />Permit; and b) provided the City with a copy of the LRRWMO permits, c) <br />provided the City with a revised site plan in accordance with improvements <br />approved by the City Counci. No Certificate of Occupancy for the Structure will <br />be issued until the Required Improvements, or a financial surety for same, are <br />accepted by the City. <br /> <br />IMPROVEMENT CONSTRUCTION SCHEDULE. The Required <br />Improvements shall be constructed and completed before July 1, 2005. <br /> <br />RECOGNITION OF LOCATION. The Permittee agrees to recognize the City <br />of Ramsey as the City. of location on all of its fon'ns of advertising and business <br />correspondence whenever reasonably prudent to do so. <br /> <br />INSPECTION FEES. The Permittee shall be responsible for all inspection costs <br />incurred by the City related to the installation of the Required hnprovements. The <br />Pen~nittee shall make a cash deposit into .the appropriate .escrow. account of the <br />City and the City shall have' the authority to draw upon these funds for the <br />purpose of compensating for inspection services. The amount of the deposit shall <br />be equal to five percent (5%) of the estimated cost of the Required Improvements, <br />which equates to One Thousand Eight Hundred Dolloars and no Cents ($1,800). <br />This escrow amount shall provide surety for the cost of constructing storm sewer <br />and parking lot improvements. Upon completion of the required Improvements to <br />the satisfaction of the City, any surplus balance remaining in the City's escrow <br />account shall be refm~ded to the Pennittee. <br /> <br />FINANCIAL ASSISTANCE. The City shall be responsible to provide the <br />financial assistance listed in Section 2.2 of the Development Agreement between <br />the parties hereto dated The payment for the Site Improvements <br />shall be made at the time a Certificate of Occupancy for the Development <br /> <br />-188- <br /> <br /> <br />
