REQUEST FOR VACATION OF EASEMENTS; CASE OF OAKWOOD LAND DEVELOPMENT, INC. By: Amy Geisler, Associate Planner Background: The property being planed as Alpine Woods includes underlying drainage and utility easements that were platted as a part of the High Point 2® Addition subdivision, specifically Lo~t' 2, Block 1. The other 5 lots that will be a part of Alpine Woods do not contain any drainage and utility easements. The Alpine Woods development will contain new drainage and utility easements around all common areas, drainage ponds, public utilities, and wetlands. The following items are enclosed for your information: Site location map Exhibit of underlying easements to be vacated Draft City Council meeting minutes dated May 25, 2004 Proposed ordinance a) b) c) d) Notification: In accordance with State Statute, City Staff attempted to notify property owners Within 350 feet of the subject property of the public hearing to vacate easements. A Public hearing was held at the May 25, 2004 City Council meeting. Observations: It takes a public hearing and Council ordinance to eliminate the Underlying drainage and utility easements that exist as part of the original High Point 2nd Addition plat. The easement vacation ordinance was introduced at the May 25, 2004 meeting and is now ready for adoption. Recommendation: City Staff recommends adoption of the enclosed ordinance to vacate the existing drainage and utility easements on Lot 2, Block 1 High Point ?d Addition.
