REQUEST FOR VACATION OF EASEMENTS; <br />CASE OF OAKWOOD LAND DEVELOPMENT, INC. <br />By: Amy Geisler, Associate Planner <br /> <br />Background: <br /> <br />The property being planed as Alpine Woods includes underlying drainage and utility easements <br />that were platted as a part of the High Point 2® Addition subdivision, specifically Lo~t' 2, Block 1. <br />The other 5 lots that will be a part of Alpine Woods do not contain any drainage and utility <br />easements. The Alpine Woods development will contain new drainage and utility easements <br />around all common areas, drainage ponds, public utilities, and wetlands. <br /> <br />The following items are enclosed for your information: <br /> <br />Site location map <br />Exhibit of underlying easements to be vacated <br />Draft City Council meeting minutes dated May 25, 2004 <br />Proposed ordinance <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners Within 350 feet <br />of the subject property of the public hearing to vacate easements. A Public hearing was held at <br />the May 25, 2004 City Council meeting. <br /> <br />Observations: <br /> <br />It takes a public hearing and Council ordinance to eliminate the Underlying drainage and utility <br />easements that exist as part of the original High Point 2nd Addition plat. The easement vacation <br />ordinance was introduced at the May 25, 2004 meeting and is now ready for adoption. <br /> <br />Recommendation: <br /> <br />City Staff recommends adoption of the enclosed ordinance to vacate the existing drainage and <br />utility easements on Lot 2, Block 1 High Point ?d Addition. <br /> <br />Council Action: <br /> <br />Motion to adopt Ordinance #04- <br />Block 1 High Point 2nd Addition. <br /> <br />to vacate certain drainage and utility easements on Lot 2, <br /> <br />City Engineer <br />City Attorney <br />Community Development Director <br />Assistant Community Development Director <br /> <br />Review Checklist: <br /> <br />CC- 06/22/04 <br /> <br />-303- <br /> <br /> <br />
