Absent: Chairperson Levine and Commissioner Bauer. <br />Abstained: Commissioner Brauer. <br />5.02: PUBLIC HEARING: Consider Request for a Variance to the Minimum Front Yard <br />Setback Standards for Lots in Woodlands 3''a Addition (Project No. 16-87); Case of <br />Lennar Corporation <br />Presentation <br />City Planner Anderson presented the staff report stating Lennar (the "Applicant") has an <br />approved final plat entitled Woodlands 3rd Addition that created twenty-one (21) new single <br />family residential lots. Lots 6-12, Block 2 and Lots 1-14, Block 3 Woodlands 3rd Addition (the <br />"Subject Property") have stormwater ponds and/or wetlands in their rear yards that will limit the <br />amount of usable area in the rear yard. The Subject Property is zoned R-1 Residential <br />(MUSA), which requires a thirty (30) foot front and side corner yard setback for buildings. The <br />Applicant is requesting a variance to allow a twenty-five (25) foot setback to create slightly more <br />usable area in the rear yards of the Subject Property. Staff recommends granting a variance to <br />allow a front and side corner yard setback of twenty-five (25) feet for the Subject Property. <br />Acting Chairperson VanScoy referenced alternative two and asked for additional clarification. <br />Community Development Director Gladhill noted that would impact lots one through five, block <br />two. <br />City Planner Anderson stated that there would be storm water pond or wetland in the backyards <br />of lots one through six, block three. He confirmed that for consistency purposes an alternative <br />would be to consider all the lots in block three and block two for the 25-foot setback. <br />Public Hearing <br />Acting Chairperson VanScoy called the public hearing to order at 7:39 p.m. <br />Citizen Input <br />Paul Tabone, Lennar, stated that there are several lots that have a presence of wetlands or storm <br />water ponds and therefore the intention is to shift the lots forward five feet to allow additional <br />backyard space and avoid runoff during the construction process. He stated that the pads have <br />been graded when they received Final Plat approval, noting that most of the site was graded <br />during the first phase of development. He thanked the Commission and stated that he would <br />appreciate the support. <br />Commissioner Nosan asked if the first five lots have been graded or if they could be made <br />consistent. <br />Planning Commission/July 21, 2016 <br />Page 5 of 20 <br />
