And MininE Permit; Case Of Mr.
Art Raudio:

City Engineer Raatikka recalled that Council approved a grading and mining
permit in May, 1987 for Art Raudio and Gilbert Menkveld. During
monitoring, it has been determined that the property at 149th and Ramsey
Blvd. has been overexcavated by 10 feet and organic materials are being
buried on the site.

Council and staff reviewed the grading plan and the City Engineer's
observations of operations on the site. It was noted that permits are
required to bring soils onto a site and Mr. Menkveld has not applied.

Mr. Raudio stated that he was not aware that another permit would be
required to bring soils onto the site. The soil he is bringing in was
intended to be used as topsoil, once the grading and mining process is
completed, to get the property saleable. Mr. Raudio stated that he wanted
to stockpile that material until the City makes a decision regarding
improvements to the airport. Mr. Raudio stated that he would be willing to
put a moratorium on any lots necessary for airport development.
City Council/July 7, 1987

Page $ of 10
