hearing on April 7. <br /> <br />City Attorney Goodrich noted that the City did not know until recently that <br />the PUD included a request to excavate fill. If the City had known, all of <br />these items could have been handled at one public hearing. <br /> <br />Mr. Raudio noted that he is requesting a conditional use permit to <br />excavate. Mr. Raudio also noted that he did know of the intent to excavate <br />at the time of the April 7 public hearing. <br /> <br />Mro Goodrich replied that a conditional use permit process requires a <br />public hearing. Mr. Goodrich noted that City Engineer Raatikka's letter <br />addresses the need for a conditional use permit in order to grade or <br />excavate. Also, the advertisement for the public hearing only addressed <br />rezoning to Planned Unit Development; it did not address any mining or <br />excavation and it cannot be assumed that those subjects are included in the <br />hearing. Mr. Goodrich noted that North Fork, Inc. came back for a <br />conditional use permit to excavate after they had gone through the planned <br />unit development process. <br /> <br />Mrl Raudio stated that he informed the City Engineer of his plans for the <br />mining but he did not know how much he would be excavating. <br /> <br />City Attorney Goodrich stated that in his opinion, the proper procedure was <br />not followed for a mining permit. <br /> <br />City Administrator Hartley commented that when Mr. Raudio brought in the <br />grading plan, staff probably should have prompted the conditional use <br />permit process. <br /> <br />Mayor Reimann encouraged Mr. Raudio to apply for a conditional use permit <br />and staff would schedule a public hearing as soon as possible. <br /> <br />City Attorney Goodrich noted that City Council could hold the public <br />hearing and bypass the Planning and Zoning Commission. <br /> <br />City Administrator David Hartley stated that the hearing could be scheduled <br />for May 26, 1987. <br /> <br />ADJOURNMENT <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Pearson to <br />to adjourn the special City Council meeting. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg and <br />Pearson. Voting No: None.
