4/5 vote i~ required to adopt zoning ordinances.

Motion by Councilmember Cox and seconded by Councilmember DeLuca to adopt
Resolution ~87-2~5 establishing an airport safety zoning ordinance for
Gateway North Industrial Airport. (Plesse refer to resolution file for
Resolution 987-245).

Further Discussion: Councilmember DeLuca stated that there is an aiport in
existence and there should be zoning in place for it; the issue of airport
zoning is separate from the issue of whether the airport will be expanded.
Councilmember Sorteberg inquired if the City is ignoring previous action
taken regarding holding an advisory election. Councilmember DeLuca replied
that a more appropriate time for an advisory election would be the second
quarter of 1988. Councilmember Pearson stated that tile zoning being
adopted will also protect the existing airport and cmn be scaled down if
necessary; whether the airport is expanded or not, it is critcal for zoning
to be adopted to protect the people that are already there.

Mayor Reimann called for a roll call vote:

Councilmember Pearson - Aye
Councilmember DeLuca - Aye
Mayor Reimann - Aye
Councilmember Cox - Aye
Councilmember Sorteberg - Aye

Motion carried.

Councilmember Cox stated that now there is action in place to which the
people can respond by petitioning for a referendum on the zoning ordinance;
by their action they may render an advisory election mute and not needed.

Councilmembe~ DeLuca stated that his understanding of the events that took
place at the Council meeting on August 25 was that Council was indicating
there should be an advisory election whether the City should have an
airport; the minutes reflect that the advisory election was to be on
whether or not safety zoning should be adopted. Counci!member DeLuca
inquired as to what the question will be if an advisory election is held in
!988 -- zoning or city ownership and operation of the airport.

Councilmember Cox replied that the question would be on zoning for the
expanded facility.

rna_ now china
w~ Eart!ey stated ' ~ Counc~'~z ~a~_ , acoD~' ~ed the =irocrt. safety,~ z
ordinance and the pecp!e can circulate a petition asking for a referendum
on the question of whether or not that ordinance should be ratified.
