Winslow }Iola~.'ek - Andover Blvd., Andover - Stated that he didn't recei,'e
notification of the October 16 hearing until October 10. Mr. Holas~k
reviewed the amount of area to bt, acquired from him and the e~.timated
assessments for sewer, water, storm sewer and MSA road and the city's
offer. Mr. Holasek stated that he has a purchase agreement offering almost
double what the city is offering for almost the same property in the same
vicinity. Mr. Holasek contended.that the city's trade for assessments
offer is actually putting the land at 1/4 of what it is worth; if property
owners are expected to pay full assessments, then the City should be
willing to pay the full worth of the property. Mr. Holasek stated that due
to the timing in which he received notification of the October 16 hearing,
he i$ requesting that Council delay that hearing to a later date.

Mr. Goodrich stated that there is nothing Mr. Holasek has to provide for
that hearing.

Mr. Holasek stated that he want~ his appraisal, which is to be paid for by
the city, and his attorney prepared for that hearing.

Mayor Reimann stated that using all the City's MSA funds for thi~ project
will hinder other needed projects in the City and noted that the property
owners would benefit from the road as much as the city wou~d.

Mr. Holasek disagreed and stated that the property owners have highway
in front of their property and don't need the frontage road; the frontage
road will depreciate residential property in that area.

Randy Eiofson inquired if the city is willing to offer the appraised value.

Councilmember Cox stated that he is not willing to offer the appraised
value as the City is u~ing tax increment revenue from another development
area (that paid for all their improvements up front and provided all the
necessary easements) to pay for sewer and water service in this area. The
city also has limited MSA funds and there are some much needed east/west
corridors. Accesses to Hwy. #10 will be very limited and further
development of this subject area will require construction of service
roads; if the MSA road is not provided for at this time, developers of the
area will be responsible for construction of it in the future.
Councilm~ber Cox stated that he doesn't know of any other development in
Ramsey where the efforts of another development area were used to provide
sewer and water with deferred assessments allowable. Council.member
s~ated that if the oppornuni[y exists, get:lng sewer and water to this area
via the Hwy. ~10 easement should be used. Counciimember Cox noted that a
high priced purchase cf easements is considered a comparable sale and will
affect land valuation and property ta;~'es for adjacent property.

Mr. Goodrich stated that options are: i) Continue condemnation through
the courts. 2~**is process has the ~_~''-~. defending it's appraisal and the
property owner's would defend theirs; the minimum the city would end up
paving~ for the easements is the city's appraised amount, ~2~,000/ac~~ ~ e. 25·
Delay court hearing and continue to negotiate; 3) Cease conde.mnation and
C~y Courczl/0ctober,~,~ ~ t987
