Case #8: Discuss Development Permi~ For Plants And Thin~s; Mr. Goodrich stated that Mr. Hickman has not yet signed the development permit agreed to in February, 1987 relating to the construction of a pole building at Plants and Things. Mr.~ Goodrich stated that Mr. Hickman has forwarded a letter stating that he cannot comply with the termB in the agreement because of financial reasons. Mr. Goodrich stated that the letter also states that the agreement is being reviewed by Mr. Hickman's attorney and noted that he has had 10 months to review it. Mr. Hickman inquired as to why other businesses along Hwy. #10 were not required to do some of the things being required of him, i.e. facing on building, surfaced parking lots, etc. Mr. Hickman stated that he is reluctant to sign the agreement because of it's contents and the cost to fulfill those requirements put on him after-the-fact. Mr. Goodrich stated that the requirements have been in existence for 5-10 years; Mr. Hickman may not have been aware of them. Council consensus was that the agreement could be amended to grant a variance to blacktopping the parking area when Mr. Hickman becomes legal owner of the property; that applying facing to the building is extended to June 30, 1988; accessory structure will be for storage and warehouse with no retail activity; and provide for off-street loading on the north side of the subject building. Mr. Hickman agreed to sign the permit as amended. Mr. Goodrich noted that a variance to blacktopping may be required to go through the public hearing process. Case ~!0: Concession Ri~hts/Pyocedurc$ For Central Park; Mr. Raatikka informed Council of what Meriand Otto found out about how other cities handle concession rights at parks. Mr. Eart!ey stated that a policy needs :o be established regarding whether there will be active concession sales during special and sporting events only or will it include open skating months; do the concession rights go to the organization sponsoring the event; who will have concession rights for open ska:ing. Counciimember DeLuca sta=ed :hat he would be iu favor of non-profit organizations operating concessions and having first choice ~o serve at their own events. ~ae concession rights policy may have to be reviewed annually. ¥~yor Eeimann mcted that vending machines is another option to consider.
