the business grows.

Chairman Peterson replied that if the conditional use permit is granted, it
will lock the property owner into certain requirements. If those
requirements need amending, the conditional use permit would be amended
with a public hearing. The conditional use permit would address issues
such as parking, storage of materials, etc. It's the Co~mission's business
to find out the operation and what is objectionable to the neighbors about
that operation.

Pat Boedigheimer - Stated that he was objecting to a business in a
residential area.

Jim Holm - Stated that if the business weren't obvious, few would object.
Hc~ever, everyone can see Mr. Ostlund's business.

Commissioner Howell inquired as to how long ~. Ostlund has lived at this
property.

Mr. Ostlund - R~plied that he has lived at this address since 1986.

Commissioner Howell inquired as to how long Mr. Ostlund has been operating
a business frem his home.

Mr. Ostlund - Raplied that he has operated frcm this home for one year and
before that he operated from his home in Coon Rapids for three years and
had not received any complaints.

Commissioner Howell inquired as to Mr. Ostlund's lot size.

F~. Ostlund - R~plied that his lot is 2-1/2 acres.

Chairman Peterson explained that the Planning Commission is an advisory
commission and will make a recommendation to the City Council and City
Council will take final action on the request.

Commissioner Deemer inquired if Mr. Ostlund was told that a business use
would be permitted on the property when he purchased it.

Mr. Ostlund - Replied that he was not told that he could operate a business
from the property, but that issue was not specifically addressed.

Mr. Weisenburger - 8005 142nd Avenue N~- Inquired why there is even any
discussion when the property is zoned for residential use.

Chairman Peterson replied that the City offers conditional use permits for
certain home occupations and allows them to be non-conforming uses with
specific conditions for operation. Anyone is welcome to request a
conditional use permit, however, the City does not have to grant that.

Motion by Commissioner Deemer and seconded by Commissioner Shumway to
adjourn the public hearing.
P&Z Public Hearing/April 7, 1987
