Board Member introduced the following resolution and moved for its adoption: RESOLUTION #04-07- A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING TERMS OF SAME. WHEREAS, Ramsey Town Center LLC, hereinafter referred to as "Applicant," has properly applied fbr a variance from Section 9.50.30(3)(a) regarding public street right-of-way width for the Ramsey Town Center 4th Addition and legally described as follows: Outlot EE, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject Property); and WHEREAS, the Board of Adjustment met on July 1, 2004,- conducted the public hearing and adopted findings of fact relating to the request for a variance from the street right-of-way requirements as part of the Ramsey Town Center 4th Addition. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows 1. Based on Findings of Fact # ., a variance to the street right-of-way requirements, as established in Section 9.50.30(3)(a) of the Ramsey City Code, to create a 58-foot wide right-of-way for 145t~' Ave. in the plat of Ramey Town Center 4t~ Addition is approved. 2. The Permittee shall dedicate 58 feet of public right-of-way for 145th Ave. on the plat of Ramsey Town Center 4th Addition. 3. The Permittee shall be responsible for all City costs incurred in processing the variance request. The motion /bt the adoption of the foregoing resolution was duly seconded by Board Member and upon vote being taken [hereon, the following voted in favor thereof: and the following voted against the same: and the tbllowing abstained: and the ~bllowing were absent: Whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this the 1 ~ day o.l:'July 2004. 27
