Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION # 04-07- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO <br />JAMES AND DIANA FEIGUM TO EXCEED THE MAXIMUM SQUARE FOOTAGE <br />ALLOWED FOR ACCESSORY STRUCTURES BASED ON FINDINGS OF FACT # <br />AND DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, James and Diana Feigum (Permittees) have properly applied for a conditional <br />use permit to exceed the maximum square footage allowed for accessory buildings for properties <br />between 1 and 1.99 acres as established in section 9.11.02 "Accessory Uses" of City Code on the <br />property generally known as 6321 163rd Lane NW and legally described as follows: <br /> <br />Lot 5, Block 3, Menkvelds Country Park, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on July 1, 2004, conducted the public <br />hearing and recommended City Council approval of the request; <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact # ., a conditional use permit (Permit) to exceed the maximum <br />allowable square fbotage for accessory building space on properties between 1 and 1.99 acres in <br />size, is hereby granted to James and Diana Feigum, hereinafter referred to as the "Permittees". <br /> <br />That the overall square footage for accessory buildings may exceed the 1,664 square foot <br />accessory building size restriction for properties between the size of 1 and 1.99 acres by a total <br />of 220 feet in order to accommodate the inside storage of private-use equipment and vehicles. <br /> <br />3. That the construction of the detached accessory building on the Subject Property shall require <br /> issuance of a building permit fi'om the City of Ramsey: <br /> <br />4. That the accessory building shall be properly constructed and maintained in accordance with all <br /> applicable International Building Codes. <br /> <br />5. The Permittees herein agree that no business use will be operated in the detached accessory <br /> building unless such use is permitted in accordance with the City Code. <br /> <br />6. That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br />7. That the Permittee shall be responsible for all City costs incurred in administering and enlbrcing <br /> this Permit. <br /> <br />8. That the City Administrator, or his/her designee, shall have the right to inspect the premises for <br /> compliance and safety pm-poses mmually or at any time, upon reasonable request. <br /> <br />11 <br /> <br /> <br />
