May 21,2004, with the requirement of a sprinkler being installed on the perimeter of the building
to spray onto the expansion area to the east.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Kurak, Pearson,
Strommen, and Zimmemmn. Voting No: None.

Case//6: Request for a Home Occupation Permit; Case of Sarah Pickhardt

Assistant Community Development Director Trudgeon reported the City received an application
from Sarah Pickhardt for a home occupation permit to establish a one person chiropractic
business in her home on the property located at 15751 Potassium Street. The applicant will be
the sole employee and expects to service a maximum of ten clients per week. Operation hours
would be primarily Monday through Friday with the last appointment scheduled no later than
9:00 p.m. The City recently issued a home occupation permit for a massage therapist with
similar hours and number of anticipated clients during a week. One letter of rejection was
received, which is included in the Council's packet. The residents, Mr. and Mrs. Greenberg, feel
the business will bring additional traffic into the neighborhood. However, it appears that the
opposition is more related to the development of River Pines, the residential subdivision located
adjacent to the oxvners' property, than the request to operate a one person chiropractic home
occupation. The Planning Commission recommended approval of the home occupation request.

Motion by Councilmember Cook, seconded by Councilmember Zimmerman, to adopt Resolution
#04-05-133 adopting Findings of Fact #0674 relating to Sarah Pickhardt's request for a home
occupation permit to operate a one person chiropractic business on the property located at 15751
Potassium Street NW..

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Zirmnerman, Elvig, Kurak,
Pearson, and Strommen. Voting No: None.

Motion by Councitmember Cook, seconded by Councilmember Zimmerman, to adopt Resolution
#04-05-134 to approve Sarah Pickhardt's request for a home occupation permit based on the
findings, of fact and declaring terms of the permit.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Zimme~rnan, Elvig, Kurak,
Pearson, and Strommen. Charter School

Assistant Community Development Director Trudgeon explained the P.A.C.T. Chm~ter School
has submitted an application for an Interim Use Permit to allow for temporary classrooms to be
placed on the school site located in the Ramsey Town Center. Due to delays in beginning
construction, the school building will not be completely finished and ready for occupancy when
school starts on September 7, 2004. The P.A.C.T. Charter School is requesting that the
temporary classrooms be located on the western parking lot from August until October 15, 2004.

P68

City Council/May 25, 2004
