<br />Councilmember Kuzma introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION #16-09-165 <br /> <br />RESOLUTION AUTHORIZING ACTION TO CONDEMN DRAINAGE AND UTILITY <br />EASEMENT <br /> <br /> WHEREAS, <br /> the property at 16259 Coquina Street contains a natural storm water <br />drainage area; and <br /> <br />WHEREAS, <br /> the City desires to obtain a drainage and utility easement over the drainage <br />area to protect it from any uses that may be adverse to storm water drainage; and <br /> <br />WHEREAS, <br /> the City desires to that its easement have priority over the existing <br />mortgage on the property, but releasing the mortgage over the easement area is not financially <br />feasible; and <br /> <br />WHEREAS, <br /> the City has statutory authority to acquire the easement by eminent domain. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) The City Council hereby authorizes staff and the City Attorney to acquire the drainage <br />and utility easement over 16259 Coquina Street by eminent domain. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Williams, and upon vote being taken thereon, the following voted in favor: <br /> <br /> Mayor Strommen <br /> Councilmember Kuzma <br /> Councilmember Williams <br /> Councilmember LeTourneau <br /> Councilmember Riley <br /> Councilmember Shryock <br /> <br />and the following voted against: <br /> <br /> None <br /> <br />and the following abstained: <br /> <br /> None <br /> <br />and the following were absent: <br /> <br /> Councilmember Johns <br /> <br />
