I <br />I <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br />I <br /> <br />I <br />I <br /> <br />Mr. Schnelle stated that auditors have advised the City to set <br />up a discretionary account in the interim, which will be presented <br />to Council at their next meeting. <br /> <br />Mr. Goodrich referred to the last sentence in Section 7.10.01 <br />and requested some clarification as to how this would affect <br />a subdivision petitioning for blacktop, for instance. <br /> <br />Mr. Sieber replied that as long as at least 80% of the project <br />is assessed out, no election is required. <br /> <br />Mr. Goodrich proceeded to review Chapter 8. <br /> <br />Mr. Goodrich referred to Section 8.03 (Council enacting suitable <br />ordinances governing local improvements and special assessments <br />within 90 days of charter adoption) and stated that basically <br />the ordinance would be a rewriting of Chapter 429 into the City's <br />own ordinance. <br /> <br />Mr. Heitman cautioned against making any mention of Chapter 429 <br />in that ordinance and noted that Mounds View has adopted an <br />ordinance that complies with their charter and Ramsey's charter <br />was modelled mostly after Mounds View's. <br /> <br />Mr. Goodrich proceeded to review Chapter 9. <br /> <br />No particular comments were made regarding Chapter 9. <br /> <br />Mr. Goodrich proceeded to review Chapter 10. <br /> <br />Mr. Goodrich noted that a series of public hearings are required <br />in order to grant a franchise. <br /> <br />Mr. Goodrich proceeded to review Chapter 11. <br /> <br />Mr. Goodrich referred to Section 11.01; City may acquire and <br />operate municipal utilities by ordinance; ordinances are subject <br />to initiative and referendum. Mr. Goodrich pointed out Mr. Raudio's <br />development as an example and stated that at some point in time <br />the water and sewer in that development will be municipal. What <br />if Mr. Raudio invests all that money in utilities and the people <br />vote down the City's acquisition of those facilities? Can the <br />City adopt an ordinance establishing utilities prior to <br />construction of the system? <br /> <br />Mr. Heitman stated that if he were a developer he would expect <br />Council's support by way of an ordinance prior to committing his <br />money. <br /> <br />Mr. Sieber stated that the ordinance should be adopted as early <br />as possible and should prescribe how utilities will be operated <br />and maintained. <br /> <br />Mr. Goodrich proceeded to review Chapter 12. <br /> <br />C/July 10, 1984 <br />Page 12 of 13 <br /> <br /> <br />
