Mr. LeFevere stated that <br />if it is Council's pleasure to deny Waste Management's <br />application, Council could use Findings of Fact prepared by P & Z <br />as a working document, make suggestions as to additions and/or <br />corrections and Staff can prepare a more formal Findings of Fact <br />for Council to adopt at it's next meeting. Mayor Gamec stated <br />that he would prefer to take a poll of Councilmembers before <br />proceeding to prepare findings of fact to deny application. <br /> <br />Councilmember Schlueter withdrew her motion and Councilmember Van <br />Wagner withdrew her second to the motion. <br /> <br />Mayor Gamec called for a Council consensus <br />Management's request for conditional use permit. <br /> <br />regarding Waste <br /> <br />Councilmember Sorteberg - Opposed <br />Councilmember Van Wagner - Opposed <br />Mayor Gamec - Opposed <br />Councilmember Reimann - Opposed <br />Councilmember Schlueter - Opposed <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember <br />Reimann to adopt Findings of Pact regarding Waste Management of <br />Minnesota, Inc.'s request for a conditional use permit, as <br />presented by Planning and Zoning with the following amendments: <br /> <br />Noise Control - Berm proposed will not sufficiently reduce <br />noise problems. <br /> <br />Odor Control - Attempts have been made to control odor <br />problems at Landfill and nothing to this point, has seemed to <br />have worked effectively. <br /> <br />Detrimental effect on property values in the near vicinity of <br />the L'andf ill. <br /> <br />I <br />I <br />i <br />I <br />i <br />I <br /> <br />Water Pollution <br />the underlying <br />pollution. <br /> <br />- Uncertainties of the Landfill's affect on <br />aquifers and potential hazards for water <br /> <br />5. Soil Conditions - Sandy soils in that area. <br /> <br />Further Discussion: Mayor Gamec stated that it should also be <br />added to the Findings of Fact that expansion to the south would <br />directly affect the homes of Cowman, Coons and Edwards. Mayor <br />Gamec also requested that Staff follow up to make sure any <br />changes to the Closure or Post Closure are mentioned. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councimembers <br />Reimann, Sorteberg, Schlueter and Van Wagner.
