Councilmembcr Cook introduced the following resolution and moved for its adoption: RESOLUTION #04-05-133 A RESOLUTION ADOPTING FINDING OF FACT #0674 RELATING TO A REQUEST FROM SARAH PICKHARDT FOR A HOME OCCUPATION PERMIT TO OPERATE A ONE PERSON CHIROPRACTIC BUSINESS ON THE PROPERTY LOCATED AT 15751 POTASSIUM STREET NW. WHEREAS, the City of Ramsey received an application from Sarah Pickhardt for a home occupation permit to establish a one-person chiropractic business within the principal dwelling on the property generally known as 15751 Potassium Street and legally described as follows: Lot 1, Block 3, River Pines 4th Addition, Anoka County, Minnesota (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That on April 6, 2004 Sarah Pickhardt, hereinafter referred to as "Applicant", properly applied for a home occupation permit to establish and operate a one-person chiropractic in her home. That the Applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.05 of the City Code on May 6, 2004, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 3. That the Subject Property is zoned R-1 Single Family Residential. 4. That the Subject Property is a single family urban lot. That chiropractic businesses are not a permitted use in the R-1 Single Family Residential District. That the Applicant has provided documentation to support that the home occupation will be conducted within the private dwelling on the property, that the area set aside for the home occupation does not exceed 20% of the total floor area of the private dwelling, and the operation will not include any employment of persons not residing in the private dwelling in the performance of the home occupation. 7. That the Applicant will reside at the location of the proposed home occupation. That the Applicant has stated that there will be no exterior storage of business equipment and materials.
