1921654 <br /> <br />Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> RESOLUTION #02-10-256 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME. <br /> <br /> WHE~AS, Strong Built Tow~omes, Inc., hereinaker refe~ed to as "Applic~t," has <br />properly applied for a variance kuru Section 9.11.09 regmding landscape requirements adjacent <br />to public roads and Section 9.11.20 (4) regarding landscape buffering requirements when a <br />commercial development is adjacent to residential ~eas for development on the propeay <br />generally located at the noahwest comer of Dysprosium St. and Coun~ Highway 116 ~d legally <br />described as follows: <br /> <br />Lot 97, Block 1, and Outlot A, Mallard Ponds, Anoka County, Minnesota. <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, the Board of Adjustment met on October 3, 2002, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from landscape <br />requirements along the northern and western property lines of the Subject Property. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> <br />Based on Findings of Fact #0633, a variance to the landscape requirements adjacent to <br />public roads, as established in Section 9.11.09 and 9.11.20 (4) of the Ramsey City Code, <br />is hereby granted for the development of a 6,000 square foot multi-tenant office building <br />on the Subject Property. <br />The variance will allow for the parking lot on the northern part of the property to be as <br />close as 10 feet from the right-of-way of 140th Avenue. <br />The variance will allow for the parking lot on the eastern part of the Subject Prope~Xy to <br />be as close as 20 feet from the property line. <br />The applicant is required to create a 20-foot landscape buffer on Lot 96, Block 1, Mallard <br />Ponds. Such landscaping shall be approved by the City of Ramsey and the Mallard Ponds <br />Homeowners Association. <br />Planting in the required buffering area shall include the required number of plantings as <br />determined by the City. <br />No building permit shall be issued until the Permittee as signed the variance and <br />reimbursed the City for all costs incurred in processing the application and has provided <br /> <br /> <br />
