Certain Improvements. The owner or subdivider, engaged in the <br /> development of lauds and properties which are zoned for Non- <br /> Residential Districts, may request City participation in the£payment of <br /> the c~sts of the installation of sanitary sewer, water system, storm <br /> sewer,~streets and curb and gutter improvements required ~ this <br /> section~and, in such event, such owner or subdivider sha~l comply with <br /> the requ~ements of this section. / <br /> 2. .Assessme~t~ The procedure for the installation and ~ssessment of the <br /> Cost of imp~vements under this section shall be the/same as that <br /> provided for ~mprovements in land in areas zoned fo~ Residential <br /> classiflcatio~pursuant to section 170.039D exce~that: <br /> a. Special asseSsments:for the cost of sanitar}/sewer, storm water and <br /> water system ~nprovements shall be for a pe/fiod of ten (10) years; <br /> <br /> b. The bond or letter of credit guaranteeing payment of the special <br /> assessments for s~nitary sewer, storm~ater and water system <br /> improvements shall~obligate the o~ner/or subdivider for the length <br /> of the assessment..~ ' / <br /> The o~ner or subdivider may elect to.~onstru~ the improvements required by this <br /> section at his own expense and withoUt~Cit~/_p~_rticipation in the expense <br /> thereof. In such event, the o~ner or s~b~vtder may retain an engineer and <br /> contractor to plan, design and install s~h services, subject to revie~ and <br /> inspection by the City Engineer. The ~Lmated cost of the improvements, <br /> including the administrative charges o~ th~ City Engineer for supervision and <br /> inspection, shall be included in the ~L-ner ~r subdivider's contract ~lth the <br /> City pursuant to Section 170.039G, .m/f the a}~ropriate security in the form of <br /> cash, letter of credit or bond shal~ be deposited with the City as required by <br /> that section. On projects ~hich p~ovide benefit to other areas in addition to <br /> the subdivider's property, the p~Ject shall be~onstructed as a City project. <br /> / <br /> 170.039~ PERFORIiANCE CONTRACT <br /> / <br /> Prior to the installation or'ny required improvements by a subdivider and prior <br /> to Council approval of the~nal plat, the subdivider shall enter into a <br /> / <br /> / <br /> / <br /> <br /> <br />
