sixty-day period after a public hearing has been held on the <br />proposed improvement, a petition n~ay be filed with the Council, <br />signed by a number of voters greater than 50% of the number of <br />registered voters at the time of the last City wide election, <br />protesting against either the improvement, or the financing <br />method, or both. In this event the Council shall not proceed <br />with the improvement, as proposed. <br /> <br />I~ · Subdivision 3. Limitations. When a proposed improvement is <br /> allowed under the foregoing subdivisions, the Council may <br /> proceed at any time between sixty days and one year after the <br /> I public hearing on improvement. However, no contraact shall <br /> the <br /> be let in the event that the lowest responsible bid exceeds the <br /> estimated cost by more than 10 percent (10~). In this event, in <br /> order to implement the proposed improvement, it shall be <br /> necessary to institute the proceedings for such improvements DE <br /> NOVO. <br /> <br />I <br />I <br /> <br /> Subdivsion 4. Reconsiderations. When a proposed improvement <br />is disallowed unde~ the foregoing subdivisions, the Council <br />shall not vote on the same improvement within a period of one <br />year after the public hearing on said improvement. <br /> <br /> i Subdivision 5. Petition By All Owners. Whenever all owners <br /> of real property abutting upon any street named as the location <br /> of any improvement shall petition the Council to construct the <br /> improvement and to assess the entire cost against their <br /> I the Council after a public hearing, <br /> property, <br /> provided <br /> in Chapter 8 of the Home Rule Charter, adopt a resolution <br /> determining such fact and ordering the improvement. <br />I 210.O1.6 Improvements/ Petition. When any petition <br /> for the making of any public improvement or in opposition to any <br /> I public improvement, the Council shall, by resolution, determine <br /> whether or not the petition has been signed by the required <br /> percentage of owners of property affected thereby, or as to the <br />i sufficiency of said petition. <br /> 210.01.7 Appeal. From Determination of Le~alit7 of Petition. <br />i Any person, being aggrieved by the determination made in <br /> Section 210.01.6 above, may appeal to the district court of..Anoka <br /> County by serving upon the Clerk of the City, within thirty days <br /> after the adoption of the resolution, a notice of appeal briefly <br />I stating the grounds of appeal and giving a bond in the penal sum <br /> of $250.00, in which the City shall be named as obligee, to be <br /> approved by the Clerk of the City, conditioned that the appellant <br />I will duly prosecute the appeal, pay all costs and disbursements <br /> which may be adjudged against him/her, and abide by the order of <br /> the court. The Clerk shall furnish the appellant a certified <br />i copy of the petition, or any part thereof, on being paid by <br /> appellant of the proper charges therefor. The appeal shall be <br /> placed upon the calendar of the next general term commencing more <br /> <br /> <br />
