Anoka, Minnesota 55303 <br /> <br />Re: Ramsey Charter Provisions - Special Assessments <br /> <br />Dear Mr. Schnelle: <br /> <br />Chapter 8 of the Ramsey City Charter has recently been <br />amended to require that local improvement projects <br />financed in whole or in part by special assessments be <br />carried out exclusively under the provisions of that <br />Chapter. You has asked whether the Charter may require <br />that such projects be carried out exclusively under the <br />charter provisions. <br /> <br />Your question is answered in the affirmative. <br />Minnesota Statutes ~429'.111 authorizes home rule <br />charter cities to proceed exclusively pursuant to <br />charter provisions where the charter or amendment is <br />adopted after April 17, 1953, and the charter provides <br />for making the improvements exclusively under the <br />charter. Chapter 8 of the Ramsey City Charter meets <br />both of these requirements. <br /> <br />You have also asked what effect does the provisions of <br />the Charter have on the City's ability to issue and <br />sell its general obligation improvement bonds. <br /> <br />Your second question is answered as follows: Th__~e <br />adoption of the charter provisions result in lenqthenF <br /> <br />f~9~ time it takes the City to issue bonds, places a <br />~-~o~~tainty over the constitutionality of the <br />bharter procedures, a-~ increases the cost of issuan~-e-. <br /> <br />The period of time it will take the City to issue bonds <br />will be increased because the charter mandates a 60 day <br />waiting period after the hearing on the improvement <br />before acting on the improvement and also requires that <br />all bids must be rejected and the assessment procedures <br />started anew if the lowest responsible bidder's bid is <br /> <br /> <br />
