SENE MOROZ <br /> <br />1) That the <br />variance to <br />by City Code. <br /> <br /> applicant properly applied for a Board of Adjustment <br />construct a detached building larger than permitted <br /> <br />~) That the applicant appeared before the Board of Adjustment <br />for a public hearing pursuant to the City Zoning Ordinance on <br />September 25~ 1984. That said public hearing was properly <br />advertised and the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />That the proposed structure is 1,350 square feet in size. <br /> <br />4) That the property is generally known as 17035 Driscoll Street <br />NW and is legally described as follows: <br /> <br />The South 200 feet of the North 1,633 feet of the West <br />383.01 feet of the East 799.01 feet of the East 1/2 of the <br />Northwest 1/4 of Section 7, Township 32, Range 25, Anoka <br />County, Minnesota. <br /> <br />5) That the subject property is less than 2.5 acres in size. <br /> <br />6) That such a variance is necessary for the preservation <br />and enjoyment of a substantial property right similar to that <br />possessed by other properties in the same district and vicinity <br />inasmuch as there are similarly sized structures on similarly <br />sized properties in the immediate neighborhood. <br /> <br />7) That the authorization of such a variance will not be of <br />substantial detriment to the adjacent properties and will not <br />materially impair the intent and purpose of this ordinance or the <br />public interest. <br /> <br />8) That the condition or situation of the specific piece of <br />property is not so general or reoccurant in nature as to make <br />reasonably practicable the formulation of a general regulation <br />for such conditions or situations. <br /> <br />9) That the variance observes the spirit and intent <br />ordinance and is not contrary to the public interest. <br /> <br />of the <br /> <br />m <br /> <br />10) That properly constructed, the structure <br />the requirements of the State Building Code. <br /> <br />will comply with <br /> <br />m <br /> <br />11) That the applicant has agreed to enter into a development <br />agreement in consideration of said variance. <br /> <br /> 12) <br />m 13) <br /> <br />m <br /> <br /> <br />
