AND Wl~EREAS, said application is made pursuant to City Code Chapter <br />170.014G, Planned Unit Development; and <br /> <br /> WHEREAS, on the 2nd day of August, 1983, the Planning and Zoning Com- <br />mission held a public hearing on the application for the P.U.D. and rezoning <br />which public hearing was properly published in the City's legal newspaper on the <br />22nd day of July, 1983; and <br /> <br /> WHEREAS, the City's Planning and Zoning Commission met on the 2nd day <br />of August, 1983 at which time it reviewed the P.U.D. application and made a <br />written recommendation to the City Council that the preliminary develo[z~ent plan <br />for the P.U.D. be approved; and <br /> <br /> WHEREAS, at its regular City Council meeting on August 23, 1983, the <br />City Council gave preliminary approval of the plan; and <br /> <br /> WHEREAS, at its regular City Council meeting held on November 13, 1984 <br />the City Council adopted Resolution ~84-223 which is a resolution approving the <br />amended preliminary plan for the Rum River Hills P.U.D.; and <br /> <br /> WHEREAS, at its regular meeting on December 4, 1984, the City's Plan- <br />ning and Zoning Commission found that the final P.U.D. was in substantial com- <br />pliance with the plan it had given preliminary approval to on August 2, 1983; <br />and <br /> <br /> WHEREAS, the entire P.U.D. shall be subject to restrictive covenants <br />and conditions in order to maintain the appearance of the development. <br /> <br />NCW ~/4EREFORE, BE IT RESOLVED BY ~]gE CITY CO[JNCIL OF 21qE CITY OF RAMSEY, ANOKA <br />COUNTY, S~I~TE OF MINNESO~I~, as follows: <br /> <br /> 1) That final approval of the Rum River Hills Planned Unit Develop- <br />ment is hereby granted subject to the following: <br /> <br />a) <br /> <br />That Rum River Hills Associates and City enter into a compre- <br />hensive development agreement which agreement shall incorpo- <br />rate all City Code requirements and City policy relating to a <br />development of this nature; and <br /> <br />b) That the Rum River Hills Planned Unit Development site be re- <br /> zoned to P.U.D.; and <br /> <br />c) <br /> <br />That the City Administrator is directed to forthwith advise <br />the applicant that this resolution has been adopted and to <br />obtain a statement in writing from the applicant to the <br />effect that its representative has received a copy of this <br />resolution. <br /> <br />d) That there be a marketable title for the property known as <br /> Rum River Hills P.U.D. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Councilmember and upon vote being taken thereon, the following voted <br />in favor thereof: <br /> <br />and the following voted against the same: <br /> <br /> <br />
