AND Wl~EREAS, said application is made pursuant to City Code Chapter 170.014G, Planned Unit Development; and WHEREAS, on the 2nd day of August, 1983, the Planning and Zoning Com- mission held a public hearing on the application for the P.U.D. and rezoning which public hearing was properly published in the City's legal newspaper on the 22nd day of July, 1983; and WHEREAS, the City's Planning and Zoning Commission met on the 2nd day of August, 1983 at which time it reviewed the P.U.D. application and made a written recommendation to the City Council that the preliminary develo[z~ent plan for the P.U.D. be approved; and WHEREAS, at its regular City Council meeting on August 23, 1983, the City Council gave preliminary approval of the plan; and WHEREAS, at its regular City Council meeting held on November 13, 1984 the City Council adopted Resolution ~84-223 which is a resolution approving the amended preliminary plan for the Rum River Hills P.U.D.; and WHEREAS, at its regular meeting on December 4, 1984, the City's Plan- ning and Zoning Commission found that the final P.U.D. was in substantial com- pliance with the plan it had given preliminary approval to on August 2, 1983; and WHEREAS, the entire P.U.D. shall be subject to restrictive covenants and conditions in order to maintain the appearance of the development. NCW ~/4EREFORE, BE IT RESOLVED BY ~]gE CITY CO[JNCIL OF 21qE CITY OF RAMSEY, ANOKA COUNTY, S~I~TE OF MINNESO~I~, as follows: 1) That final approval of the Rum River Hills Planned Unit Develop- ment is hereby granted subject to the following: a) That Rum River Hills Associates and City enter into a compre- hensive development agreement which agreement shall incorpo- rate all City Code requirements and City policy relating to a development of this nature; and b) That the Rum River Hills Planned Unit Development site be re- zoned to P.U.D.; and c) That the City Administrator is directed to forthwith advise the applicant that this resolution has been adopted and to obtain a statement in writing from the applicant to the effect that its representative has received a copy of this resolution. d) That there be a marketable title for the property known as Rum River Hills P.U.D. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same:
