I I I A~ WHEP~F_A5, sa~d application is ~3e p]rsu~,t to C~ty Code O~apte~ Planned Unit beveloFment; ~gd W~EREAS, on the 2nd day of August, 19~3, the Planning and Zoning mission held a public hearing on the application for t. be P.U.D. which public bearing was properly published in the City's legal newspaper on the 29th day of July, 1983; and WHEREAS, the City's Planning and Zoning Cor~Td ssi on met on the 2m3 da}' of August, 1983 at which time it reviewed the ?.U.D. application and made a written recorm~ndation to the City Council that the preliminary develo~ent pla.: for the P.U.D. be approved; and WHEREAS, at its regular City Council meeting on August 23, 1983, the City Council gave preliminary approval of the plan; and WHEREAS, at its regular City Council meeting held on November 13, 1964 the City Council adopted Resolution f84-223 which is a resolution approving the amended preliminary plan for the RL~, River ]~ills P.U.D.; and WHEREAS, at its regular meeting on December 4, 1984, the City's Plan- ning and Zonin9 Co~ission found that the final P.U.D. was in substantial com- pliance with the plan it had given preliminary approval to on August 2, 1983; and WHERF2%S, the entire P.U.D. shall be subject to restrictive covenants and conditions in order to maintain the appearance of the development. NC~ ~/EREFORE, BE IT RES~VED BY ~ CITY O3~NCIL (F 9T~E CITY CF RAMSEY, ANCKA O3~NT~, S~ATE (F MINNESOgA, as full,s: 1) ~[hat final approval of the Rum River ]~ills Planned Unit Develop- ment is hereby granted subject to the following: a) ~at R~ River ]~ills Associates and City enter into a oompre- bensive develou~ent agreement which agreement shall incorpo- rate all City Code requirements and City policy relating to a develol~ent of this nature; and b) ~hat the R~ River }{ills Planned Unit DevelopT~nt site be re- zoned to P.[3. D.; and c) ~hat the City Administrator is directed to forthwith advise the applicant that this resolution has been adopted and to obtain a statement in writing from the applicant to the effect that its representative has received a co~y of this resolution. ~e motion for the adoption of the foregoing resolution was duly seconded by Councilmember and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same:
